Should I request parking at Boca?

Slowing economy could increase pressure
on Big Tech

Sara Fischer, David McCabe, Courtenay Brown5 hours ago
A potential recession, combined with increasing regulatory threats for some of the biggest
tech companies, foreshadows a difficult 2019 for Silicon Valley.
Why it matters: The biggest tech companies have already raked in billions of dollars in
profits and benefited from major tax cuts that aren't going to be repeated, so next year isn't
likely to be better for them financially. They've also been dogged by scandals that have left
many questioning their positive role in society, and if on top of that the economy starts to
slip, 2019 could be worse.
"People look for scapegoats in a bad economy. And with big tech already on its heels, a
downturn probably would feed arguments that the largest internet companies are too big
and need to be reined in."
— Paul Gallant, an analyst with Cowen Washington Research Group
Big Tech is closing out a contentious year in Washington, and potential regulation will
continue to haunt it well into 2019.
• Google CEO Sundar Pichai has agreed to testify before Congress, and will likely be
asked about whether the company is being transparent about its data privacy practices and
any potential bias. By the year's end, the CEOs of Twitter, Google and Facebook will have
been called to testified in front of Congress for the first time ever during 2018.
• Lawmakers in the United States are pushing for a federal privacy law with an urgency
likely to be exacerbated by more breaches like the one Marriott disclosed last Friday.
• The Federal Trade Commission still has an open investigation into whether
Facebook's conduct violated a previous settlement with the agency. Margrethe Vestager,
HOUSE OVERSIGHT 033395
Europe's aggressive commissioner overseeing competition, is still investigating aspects of
Google's business and whether Amazon plays fair in the market for generic products.
• President Trump has said his administration is seriously looking into monopolistic
behavior of Facebook, Google and Amazon.
Some analysts predict an economic slowdown___even if it doesn't lead to a recession like
the one in 2008___will be enough to change the global attitude around big American
companies.
"So the really shocking thing this year is that the only major economy in the world where
growth has actually accelerated this year is America. And this is because of the tax cuts, the
deregulation, the other stimulus which has been put into work. And that has also helped the
earnings of companies. My point is, from next year onwards, those effects begin to fade."
— Ruchir Sharma, chief global strategist at Morgan Stanley on Fareed Zakaria GPS
on Sunday
The "FAANG" stocks (Facebook, Amazon, Apple, Netflix and Google) that pushed the
stock market to record highs have not been immune from this year's market rout.
• "The mood has changed. Investors are asking a lot more questions right now," says
Larry Glazer, a Managing Partner at Mayflower Advisors, which manages $3 billion.
"Momentum has faded on these names."
• Adding to potential concern: possible regulatory action could translate into higher
costs, particularly for Google or Facebook.
• "Facebook has been under such a dark cloud for so long that now everybody is
expecting the worst," Paul Meeks, a technology portfolio manager at Wireless Fund, told
Amos.
The other side: "I don't see a looming recession. And even if there was, people aren't going
to target these companies if there is a recession," says Nicholas Economides, Professor of
Economics at NYU Stem School of Business.
• Economides argues that, even if there was a mild reduction in GDP growth, it
wouldn't significantly impact the high tech sector.
• For companies like Google, Facebook and Twitter, "their main revenue streams are
from ads. They gain market share from brands converting traditional ad spend to digital ads.
This conversion is not so dependent on the growth of GDP, because they are still in the
process of converting ads of different formats to digital ads, and that's something that will
continue, regardless of GDP growth."
The bottom line: Tech companies that have long been the darlings of investor portfolios
will likely find themselves in much weaker positions.

A Trump Employee Said He Knew Of Misconduct At The Company. Then He Claimed His Family Was Assaulted. A mother and her young son said they were terrorized by Trump security in 1995, after a family member announced plans to reveal “financial improprieties.”

Donald Trump’s security guards once shoved, threatened, and held a 12-year-old boy and his mother against their will after her husband promised to go public with damaging allegations against the Trump Organization, according to the family’s account in FBI records and court filings.

The incident is one of several in which Trump surrogates have been accused of going to extreme lengths to protect him.

A bankruptcy attorney who represented Trump Entertainment Resorts investors once received a phone call warning him “if you keep fucking with Mr. Trump, we know where you live and we’re going to your house for your wife and kids.” A New York City housing commissioner told the NYPD his life was threatened for refusing to grant a $20 million tax abatement for the construction of Trump Tower. Trump’s personal lawyer, Michael Cohen, told Daily Beast reporters that he would “mess your life up” before they published a story saying Trump made his first wife feel “violated” during sex.

This time, it was September 1995 and Daut Bajrushi, a superintendent at one of Trump’s buildings, claimed he could prove “financial improprieties” and other misconduct by the Trump Organization. Bajrushi, then 46 years old, worked at Trump Palace, a skyscraper on Manhattan’s Upper East Side. After four years on the job, Bajrushi believed he had evidence the Trump company had ripped off homeowners of about $300,000.

Days before he was to reveal this information to board members at Trump Palace, Bajrushi fell ill and sent his wife and 12-year-old son to retrieve items from his office. They were gathering paperwork, according to a suit Bajrushi later filed, when someone used a screwdriver to bust the lock. The door burst open and a team of Trump security officials poured in.

According to the lawsuit, four men prevented Hatixbe Bajrushi and her son from leaving. Matthew Calamari, the hulking head of security, shoved the boy. Trump’s brother-in-law, James Grau, barked questions, demanding to know why they were there. Michael Nicoll, another guard, pushed them back when they tried to leave. Grau snatched her purse and passed it to Calamari, Nicoll, and Domenic Pezzo to rifle through.

The boy started to cry and his mother fainted, they claim. Daut Bajrushi, informed by his wife in a phone call of what was happening, had a friend call the police.

Calamari threatened to harm the family if they spoke to police about what happened, according to the lawsuit. After 90 minutes, the police arrived and the Bajrushis were freed.

The White House declined to respond to a request for comment, referring questions to the Trump Organization.

“The allegations, from over 20 years ago, are completely inaccurate, ridiculous and utterly false,” a Trump Organization spokesperson wrote in a statement. “This individual was rightfully terminated following a thorough investigation."

After the confrontation, Calamari continued to climb the ranks at the Trump Organization, working his way up to his current title: executive vice president and chief operating officer.

None of the security guards were charged in this case. Even though its officers were called to the scene, the New York Police Department has refused to turn over records about the case, citing privacy concerns. The incident was cited in an FBI document obtained through the Freedom of Information Act by BuzzFeed News and Ryan Shapiro, an MIT doctoral student. The document was compiled as part of a racketeering investigation. The FBI would not disclose what became of that probe but two agents with knowledge of the case told BuzzFeed News Calamari and Pezzo were questioned by the Bureau as “persons of interest.”

A lawsuit filed by the Bajrushi family says the altercation arose out of Daut Bajrushi’s claims that he had damaging information about the Trump Organization. Bajrushi said in court papers that he had evidence that the Trump Organization was using Trump Palace employees to do “punch list work” — post-construction maintenance — on condominium units owned by the company. Trump Palace, which was controlled by the tenants, was owed about $300,000 by the Trump Organization, Bajrushi estimated.

He said he planned to reveal his findings at a Trump Palace board meeting that was just days later.

In response to the false imprisonment lawsuit filed by the family, the Trump Organization countered with claims that Bajrushi was disloyal, committed fraud, and embezzled money. Hatixbe Bajrushi was attempting to destroy evidence of these alleged schemes, according to the Trump Organization, when security guards showed up to stop her. In their response to the lawsuit, Calamari and Nicoll said that they told the woman and her child they were free to leave, but that they couldn’t remove any Trump Palace property.

Trump Organization attorneys also accused Bajrushi of installing an “electronic device” that allowed him to illegally eavesdrop and record telephone calls made by Trump Palace workers between 1991 and 1995.

BuzzFeed News has reported that the Trump Organization has an extensive surveillance system at homes, hotels, and golf properties that former workers say was used to spy on employees.

BuzzFeed News tried to reach the Bajrushis at an apartment building in Manhattan and two homes in upstate New York. They did not return multiple letters and phone calls seeking comment.

In court documents, the Trump Organization and the security team denied any wrongdoing, although they concede that the police were called to the scene. Calamari and Pezzo did not return multiple messages seeking comment.

The lawsuit never went anywhere, and the legal bills piled up for Bajrushi. His attorney met with Trump and his attorney, Jay Goldberg, to discuss a settlement. Bajrushi’s attorney, Jonathan Mark, said Trump made no offer.

Trump Officials Tried To Rush Nuclear Technology To Saudis, House Panel Finds
by Tim Mak
NPR - Heard on All Things Considered
February 19, 201912:55 PM ET

[x]
A new interim report from the House Oversight Committee details Trump administration officials' efforts to transfer nuclear technology to Saudi Arabia. Saudi Crown Prince Mohammed bin Salman, pictured here, visited the U.S. in March 2017. Andrew Cabellero-Reynolds/AP

The Trump administration sought to rush the transfer of American nuclear technology to Saudi Arabia in potential violation of the law, a new report from the House Oversight and Reform Committee alleges.

Committee Chairman Elijah Cummings' staff issued an "interim staff" report Tuesday, citing "multiple whistleblowers" who raised ethical and legal concerns about the process.

"They have warned about political appointees ignoring directives from top ethics advisers at the White House who repeatedly and unsuccessfully ordered senior Trump administration officials to halt their efforts," the report states. "They have also warned of conflicts of interest among top White House advisers that could implicate federal criminal statutes."

The committee's report alleges that the major drivers behind the effort to transfer U.S. nuclear technology were retired Gen. Michael Flynn, who served as the president's national security adviser, and Thomas Barrack, who chaired Trump's inauguration committee. Flynn was fired in February 2017 for lying about conversations with the Russian ambassador to Vice President Pence and the FBI.

For about seven months in 2016, including during the presidential transition, Flynn served as an adviser to IP3 International, a private company seeking to build nuclear plants in Saudi Arabia.

The whistleblowers told the committee that Flynn continued to advocate for IP3's plan even after he joined the White House as the president's national security adviser in 2017.

The Atomic Energy Act requires that Congress approve any transfer of nuclear technology to a foreign country. The committee's report states that a senior director at the National Security Council (NSC), Derek Harvey, "reportedly ignored ... warnings and insisted that the decision to transfer nuclear technology to Saudi Arabia had already been made."

The NSC's lawyers realized that Flynn had a possible conflict of interest that could violate the law, the whistleblowers said, and told NSC staff to stop working on the nuclear technology transfer plan. Despite Flynn's firing in February 2017, the plan appeared to continue to progress with Barrack's support.

The committee announced that it intends to launch an investigation into this matter "to determine whether the actions being pursued by the Trump administration are in the national security interests of the United States, or, rather, serve those who stand to gain financially as a result of this potential change in U.S. foreign policy."

Shortly after the release of the report, House Intelligence Committee Chairman Adam Schiff, D-Calif., announced that his panel would be coordinating with Cummings' staff to explore these allegations.

Tuesday's disclosure of a plan to sell nuclear technology comes as the United States considers its relationship with the Saudi government in the wake of the killing of writer Jamal Khashoggi.

Following his death, the House and Senate have both passed resolutions to limit U.S. involvement in the Saudi-led coalition fighting in the Yemeni civil war. The Senate also passed a resolution by voice vote — reflecting unanimity — that was fashioned to "hold Crown Prince Mohammed bin Salman responsible for the murder of Jamal Khashoggi."

The report also comes as President Trump's son-in-law, Jared Kushner, is scheduled to travel next week for a trip to the Middle East that includes a stop in Riyadh, the Saudi capital.

The White House did not immediately respond to a request to comment on the committee's report.

NPR's Ayesha Rascoe contributed to this report.

Ex-Trump lawyer Michael Cohen gets prison surrender date delayed two months to May 6
by Dan Mangan & Kevin Breuninger

• President Donald Trump's former personal lawyer Michael Cohen was given a two-month extension for his scheduled date to surrender to federal prison.
• Cohen will now have to surrender to prison on May 6 to begin a three-year sentence, Judge William Pauley ordered.
• Cohen's attorney requested the delay, citing the fact that Cohen had "recently underwent a serious surgical procedure" and needs to prepare for testimony to three Congressional committees by the end of February.

President Donald Trump's former personal lawyer Michael Cohen was granted a two-month extension of his prison surrender date Wednesday after his attorney cited his need to continue recovering from recent shoulder surgery, and to prepare for upcoming testimony before three congressional committees.

Cohen, 52, will now enter federal prison May 6 to begin his three-year sentence, Judge William Pauley ordered.

Cohen was originally set to begin that sentence March 6. He pleaded guilty last year to financial crimes, lying to Congress and campaign violations related to hush money payments made to two alleged sexual partners of Trump's.

The United States Attorney's Office for the Southern District of New York, one of two entities that prosecuted Cohen, did not oppose the "one-time" extension of his surrender date given his medical condition, according to Cohen's lawyer, Michael Monico.

A spokesman for Southern District prosecutors, as well as for special counsel Robert Mueller, Cohen's other prosecutor, declined to comment to CNBC.

Monico, in a letter to Pauley requesting the 60-day delay, cited the fact that Cohen "recently underwent a serious surgical procedure and he needs to undergo intensive post-surgical physical therapy and be monitored by his physician for recovery."

Monico also noted that Cohen "also anticipates being called to testify before three ... Congressional committees at the end of" February.

"Doing so will required Mr. Cohen to spend substantial time in preparation that will limit the time he has to get his affairs in order and spend time with his family, especially given such a short period between the anticipated hearings and the present reporting date," Monico wrote.

Cohen is set to testify Feb. 28 before the House Intelligence Committee. That hearing will be be closed to the public.

He is also committed to testifying at a closed session of the Senate Select Committee on Intelligence, and in a public session of the House Oversight and Government Reform Committee. The dates for those other two hearings have not been released.

Spokesmen for all three committees did not immediately respond to requests for comment.

Cohen since last year has been cooperating with Mueller's ongoing investigation of Russian interference in the 2016 president election and issues related to the Trump campaign.

Mueller's office had charged Cohen with lying to Congress about details of an aborted plan to build a Trump Tower in Moscow.

Cohen admitted that he misled Congress about the date when that plan was dropped and about the extent of Trump's personal involvement in the deal.

Cohen had originally claimed the project was abandoned much earlier in 2016, when Trump was running for the Republican nomination for president, than when it actually was dropped. He also falsely said that Trump was less involved in the effort than the president actually was, according to Cohen's guilty plea.

Cohen has also admitted facilitating hush money payments to two women, porn star Stormy Daniels and Playboy model Karen McDougal, at the direction of Trump in 2016 to keep them quiet about their alleged affairs with president a decade earlier. Cohen has said the goal of those payments was to avoid the women's stories affecting the election that year.

The U.S. Attorney's Office for the Southern District of New York is continuing to investigate those payments. That inquiry, and others related to Trump by the same office, is seen as a serious legal threat to Trump.

Trump has denied having sex with either woman, and has also denied any other wrongdoing.
