"With the help of Wackenhut and the Cabazons, according to Ben-Menashe, the U.S. developed its own version of the back-door and the U.S. and Israel began looking for a neutral company through which it could sell the program to foreign intelligence services. The company chosen for the task was Degem, a computer firm with offices in Israel, Guatemala and the South African Bantustan homeland. It had been taken over for the purpose by Robert Maxwell, the publishing mogul who drowned under mysterious circumstances in 1991.

Maxwell's body was found floating in the ocean near his yacht, the Lady Ghislaine, off the Canary Islands on November 5, 1991. He had not been seen for hours preceding his death. These types of rumors, of connections to Mossad and other international spy groups, had long circulated about Maxwell, and his publishing empire's finances had come under official review. Nevertheless, Spanish authorities concluded that Maxwell died of a heart attack, although he had no history of heart disease. Maxwell's daughter Ghislaine said the family was satisfied with the investigation, but his sons, widows and lawyers insisted that the death was accidental, perhaps with an eye toward Maxwell's $35.8 million insurance against accidental death. One of the forensic specialists who worked on the autopsy later noted that a perforation under Maxwell's left ear could have been caused by an injection of a lethal substance. Labor Party MP George Galloway openly speculated in the British House of Commons that Maxwell was murdered because 'dead men tell no tales.' Britain's PM John Major was even moved to deny publicly that British intelligence was investigating Maxwell's finances after his death. By 1995, however, Britain's Serious Fraud Office had spent $13.9 million tracing Maxwell's web of over 400 companies (Reuters, 2/15/95), resulting in charges against Maxwell's financial advisors, Larry Trachtenberg and Robert Bunn, and his two sons, Ian and Kevin, for defrauding pensioners. A second charge of conspiring with his father was brought against Kevin Maxwell, age 36. The charge claimed that months before the elder Maxwell's death, he and his son used other pension assets and shares in another Israeli company, Scitex Corporation, to illegally raise money for other Maxwell companies (Reuters, 5/26/95). The collapse of Maxwell's empire -- which ultimately led to son Kevin standing in the unemployment line and widow Elisabeth unsuccessfully fishing for a publisher to handle her memoir -- began well before he died, lending credence to the suicide theory."

"[Robert] Maxwell's role as a cutout for a foreign nation's sale of computer software has been implicitly acknowledged by the actions of the FBI. Robert Maxwell's dissemination of computer software was the subject of an FBI foreign counterintelligence investigation in 1984. Ten years later, in January 1994, Inslaw obtained, under the Freedom of Information Act (FOIA), 18 pages relating to an investigation on this subject in New Mexico in June 1984. The FBI furnished the documents to Inslaw in response to a FOIA request for documents relating to Maxwell's involvement in the 'dissemination, marketing or sale of computer software product, between 1983 and 1992.' The FBI heavily redacted the 18 pages and ascribed the redactions to the secrecy requirements of national security. One month before the FBI released the documents to Inslaw, it partially reclassified two of the pages that had been officially declassified in their entirety one year earlier. The FBI redacted the newly reclassified portions in the copies given to Inslaw.

"Robert Maxwell also developed a business relationship during the latter half of the 1980s with two computer systems executives from the Meese Justice Department, at least one of whom had responsibilities relating to the proprietary version of PROMIS. Robert Maxwell set up a tiny publishing company in McLean, Virginia, in August 1985. That company then hired two senior computing systems executives from a unit of the Meese Justice Department that operated the proprietary version of PROMIS. One was the Director of the Justice Data Center, the Justice Department's own internal computer time-sharing facility where the proprietary IBM version of PROMIS was operating for one of the legal divisions under license from Inslaw. The Director of the Justice Data Center resigned his estimated $90,000-a-year Senior Executive Service position to become Vice President for Technical Services at the six-employee start-up national defense company owned by Robert Maxwell." An explosive new report has asserted that deceased sex criminal Jeffery Epstein and his alleged 'madame' Ghislaine Maxwell were foreign intelligence 'assets', and that she is currently hiding in a safehouse in Israel.

'Ghislaine is protected. She and Jeffrey were assets of sorts for multiple foreign governments. They would trade information about the powerful people caught in his net — caught at Epstein's house,' a unnamed source told Page Six.

Maxwell, 58, has been accused in lawsuits of procuring underage girls for Epstein to sexually traffick among his wealthy and powerful friends, and is reportedly the subject of an ongoing FBI probe.

She has always denied any wrongdoing. Her attorney did not immediately respond to an inquiry from DailyMail.com on Wednesday evening.

After Epstein's re-arrest last year and death behind bars in August, Maxwell has remained out of sight and her whereabouts unknown.

Now the Page Six source claims she is being protected by powerful foreign interests.

'She is not in the US, she moves around. She is sometimes in the UK, but most often in other countries, such as Israel, where her powerful contacts have provided her with safe houses and protection,' the source said.

Maxwell is being 'protected because of the information she has on the world's most powerful people,' the source said.

The source also claimed that Prince Andrew begged Maxwell to come forward and clear his name, after Virginia Roberts Giuffre claimed Epstein forced her to have sex with the royal when she was 17.

Prince Andrew, 59, strenuously denies having sex with Roberts and claims he can't remember meeting her despite a photograph of him with his arm around her.

'Andrew pleaded with Ghislaine to publicly defend him. She carefully considered it, but decided no good would come of it (if she came forward). It isn't in her best interests,' the source told Page Six.

Andrew resigned from royal duties after giving a disastrous interview on Newsnight in November.

It is not the first time that Epstein has been tied to a foreign intelligence service. Rumors have long circulated that Epstein secretly took videos of his rich and powerful friends having sex with underage girls, either for financial blackmail or as leverage for a foreign intelligence service.

So far, however, the FBI has not publicly confirmed whether any such blackmail material was recovered in raids on his properties.

Since Epstein's arrest on federal sex trafficking charges in July, Maxwell has remained out of sight, save for photos that purported to show her at an In-and-Out Burger in Los Angeles. DailyMail.com revealed that those photos were staged, possibly to throw investigators off of her trail.

Born in France, Maxwell is both a U.S. citizen and British subject. Her family's alleged ties to Israel's national intelligence service, Mossad, have been well documented.

Maxwell's father, Robert Maxwell, was a Czech-born British media mogul whose financial fraud in raiding the Mirror Group pension fund was discovered after his death in 1991.

Also a British member of parliament, Robert Maxwell reportedly had ties to British intelligence, the Soviet KGB, and Mossad — and was suspected of being a double or even triple agent by British Foreign Office officials.

After his mysterious death on his yacht, the Lady Ghislaine, off the Canary Islands in 1991, Robert Maxwell was buried in Jerusalem with high honors, with Israel's prime minister and multiple current and former heads of Israeli intelligence services in attendance at the funeral.

His favorite daughter, Ghislaine, first met Epstein in the early 1990s, at a party in New York City.

The two had a romantic relationship for several years, but the exact nature of their relationship over the following decades remains unclear.

Epstein's household staff have described her as 'Lady of the House' and sworn in depositions that she was at the center of managing his household affairs.

'They were like partners in business,' Janusz Banasiak, Epstein's house manager, said in a deposition.

Epstein's butler, Alfredo Rodriguez, described Ghislaine Maxwell in a deposition as 'the boss.'

Epstein's accusers have said that Maxwell's authority extended to managing the complex logistics of his perverse activities with girls as young as 14.

'She orchestrated the whole thing for Jeffrey,' said Sarah Ransome, one of some two dozen women who spoke out before a federal judge in New York in August.

Some of the most serious allegations have come from Virginia Roberts Giuffre, who accused Maxwell in a lawsuit of luring her to become an international sex slave for Epstein and his pals.

Roberts says that she was 16 or 17 in the summer of 2000 and working as a towel girl at Mar-a-Lago when Maxwell approached her, eventually leading to her being flown around the world on Epstein's 'Lolita Express.'

Roberts' recently unsealed lawsuit claims that Maxwell 'actively took part in recruiting underage girls and young women for sex with Epstein, as well as scheduling the girls to come over, and maintaining a list of the girls and their phone number.'

Maxwell has strenuously denied in the past that she was involved in criminal sex trafficking or any other sex crimes.

After Epstein took a sweetheart plea deal in 2008 to state charges of procuring for prostitution and served a one-year jail sentence in Florida, Maxwell and Epstein were no longer spotted together at public events.

She remained active on the New York social scene for several years, however, until mounting lawsuits and allegations began to draw harsher scrutiny.

In April of 2016, the New York townhouse where she had lived was sold for $15 million, and around the fall of 2016, she was no longer seen or photographed publicly.

She was last spotted publicly at a social event in Geneva, Switzerland on June 8, less than a month prior to Epstein's re-arrest in the U.S.

Earlier this week, the Epstein accuser Virginia Roberts called for Maxwell to be brought forward to face the justice system.

Epstein died in federal custody in August while facing sex trafficking charges. His death was ruled a suicide by New York City's medical examiner, but his lawyers have disputed that finding.

Epstein's death, at age 66, came a little over a month after he was arrested and charged with trafficking dozens of underage girls as young as 14 from at least 2002 to 2005. Prosecutors said he recruited girls to give him massages, which became sexual in nature.

[Maria] And now, the President of the United States, Donald J. Trump, on the telephone. Mr. President, thank you very much for being here.

[Trump] Thank you, Maria. Thank you.

[Maria] It is great to have you, and I want to say, that Americans today have a lot of questions this morning, Mr. President. We hope you can be as precise as possible, and we can get through as much as possible this morning. Thank you for talking with us in the first interview since Election Day.

Mr. President, you've said many times that this election was rigged; that there was much fraud. And the facts are on your side. Let's start there. Please go through the facts. Characterize what took place.

[Trump] Well, first of all, I have to start by saying that the whole world is watching, and nobody can believe what they're seeing, and you have leaders of countries that call me and say, "That's the most messed up election we've ever seen."

You start with these machines that are suspect, not allowed to be used in Texas -- the Dominion machines, where tremendous reports have been put out, we have affidavits from many people talking about what went on with machines, they had glitches. Do you know what a glitch is? A glitch is supposed to be when a machine breaks down. Well, no, we had glitches where they moved thousands of votes from my account to Biden's account. And these are glitches.

So they are not glitches, they are theft! They are fraud! Absolute fraud! And there were many of them. But obviously most of them, you know, tremendous amounts, got by without us catching -- we got lucky to catch them. I think we caught four or five glitches of about 5,000 votes each. And different states. And again, they are not glitches, that was fraud. And they got caught. But, for the most part, they got away with it.

And what happened, if you watched the election, I was called by the Biggest People saying, "Congratulations." Political people. "Congratulations, Sir, you just won the election." It was 10:00, and you looked at the numbers, and I'm sure you felt that way. This election was over. And then they did DUMPS. They call them DUMPS. BIG MASSIVE DUMPS in Michigan, in Pennsylvania, and all over. If you take a look at almost every state that we're talking about, swing states that we're talking about, and they did these massive dumps of votes, and all of a sudden I went from winning by a lot to losing by a little. And in some cases, it took a period of time to do it. In North Carolina, they couldn't do it. I won North Carolina. They couldn't -- somehow they had a better system. But they couldn't do anything. I believe they tried. We have affidavits. But they couldn't do anything with -- it's really a great place, North Carolina. I appreciate the incredible work that they put in, and we won. But they did tens of thousands, tens of thousands of Biden votes. And all of a sudden, I went from -- and I could tell you the people that were calling me and congratulating me are people that you know very well: Friends of your show. They said, "It's over." I said, "Well, I hear bad things about the machines; I hear bad things about corruption." One of your great pollsters, who actually got it right -- you know, the gentleman I am talking about -- he said, "Well, Trump is going to win Pennsylvania, but you have to allow at least 5% for cheating, because they cheat. And that's in Philadelphia, and various areas around Philadelphia. They cheat, and they cheat like crazy. So we have him winning Pennsylvania, but you have to allow 5 points for cheating."

This is a TERRIBLE thing that has happened! The mail-in ballots are a disaster. They sent millions and millions and millions of mail-in ballots. I'm sure you know people who got 2, 3 or 4, because I do, where they said, "I got four ballots: I got one at a country home." Dead people were seeing ballots. But even worse, dead people were applying to get a ballot. They were making application to get ballots. Many. And you know, we're not talking about ten people. We're talking, THERE ARE A LOT OF DEAD PEOPLE that so-called "voted" in this election. But dead people, in some cases, in many, many cases, THOUSANDS OF CASES, voted. But also dead people made application to vote. They were dead ten years, 15 years, and they actually made application.

THIS IS TOTAL FRAUD, and how the FBI and Department of Justice -- I don't know, maybe they are involved, but how people are allowed to get away with this stuff is unbelievable.

THIS ELECTION WAS RIGGED! THIS ELECTION WAS A TOTAL FRAUD! And it continues to be as they hide. And the problem we have, we go to judges, but people don't want to get involved. The media doesn't even want to cover it! You're doing something -- you're actually very brave, because you're doing something the media doesn't want to talk about it. They know how fraudulent this is! It's no different than Hunter [Biden]! It's no different than Hunter! They don't want to talk about Hunter! So they totally closed it off -- Big Tech and the media, other than the New York Post, as you remember, which took a lot of heat. It was terminated. It was terminated from, I guess, Twitter.

By now, it’s well-established that most of the arguments put forward by President Trump’s reelection campaign in its challenge of the results of the 2020 election are baseless and highly speculative. Even Trump allies, as The Washington Post reported late Tuesday, acknowledge the apparent futility of the effort. Others have reasoned that there’s no harm in going through the motions, with one anonymous GOP official asking, “What’s the downside for humoring him” for a little while?

But as scenes in courtrooms nationwide in recent days have shown, there is indeed a downside for those tasked with pursuing these claims. Repeatedly now, they have been rebuked by judges for how thin their arguments have been.

The most famous scene came in Pennsylvania, where a Trump lawyer strained to avoid acknowledging that their people were, in fact, allowed to observe the vote-counting process in Philadelphia:

At the city’s federal courthouse on Thursday evening, attorneys for Trump asked a judge to issue an emergency order to stop the count, alleging that all Republican observers had been barred.

Under sharp questioning from Judge Paul S. Diamond, however, they conceded that Trump in fact had “a nonzero number of people in the room,” leaving Diamond audibly exasperated.

“I’m sorry, then what’s your problem?” asked Diamond, who was appointed to the federal bench by President George W. Bush. Denying Trump’s request, Diamond struck a deal for 60 observers from each party to be allowed inside.

At one point on Friday afternoon, 12 Republican observers and five Democrats were watching the count, according to a ballot counter who was working.

After that “nonzero” answer, Diamond pressed the Trump campaign lawyer to be more explicit — and he suggestively invoked their standing with the bar: “I’m asking you as a member of the bar of this court: Are people representing the plaintiffs in the room?” The lawyer responded more directly: “Yes.” By the end of the hearing, Diamond invoked his right to make sure lawyers in his courtroom acted in good faith.

Another Trump lawyer, Jonathan S. Goldstein, was also grilled by a Pennsylvania judge this week. Under questioning, he acknowledged that, contrary to Trump’s claims about rampant voter fraud, he wasn’t alleging fraud in the 592 ballots he sought to disqualify in Montgomery County, Pa.

Again, Trump’s lawyer strained to avoid directly answering the question but was ultimately forced to acknowledge it:

THE COURT: In your petition, which is right before me — and I read it several times — you don’t claim that any electors or the Board of the County were guilty of fraud, correct? That’s correct?

GOLDSTEIN: Your Honor, accusing people of fraud is a pretty big step. And it is rare that I call somebody a liar, and I am not calling the Board of the [Democratic National Committee] or anybody else involved in this a liar. Everybody is coming to this with good faith. The DNC is coming with good faith. We’re all just trying to get an election done. We think these were a mistake, but we think they are a fatal mistake, and these ballots ought not be counted.

THE COURT: I understand. I am asking you a specific question, and I am looking for a specific answer. Are you claiming that there is any fraud in connection with these 592 disputed ballots?

GOLDSTEIN: To my knowledge at present, no.

THE COURT: Are you claiming that there is any undue or improper influence upon the elector with respect to these 592 ballots?

GOLDSTEIN: To my knowledge at present, no.

The Trump campaign also sought to temporarily stop counting some ballots in Detroit. It cited a GOP poll watcher who had said she had been told by an unidentified person that late mail ballots were being predated to before Election Day, so they would be considered valid.

The judge repeatedly asserted this was hearsay, but Trump campaign lawyer Thor Hearne sought to argue that it wasn’t — despite it having been someone who said they heard about something they weren’t personally involved in. He pointed to a vague note the poll watcher produced — which said “entered receive date as 11/2/20 on 11/4/20” — as evidence:


STEPHENS: So I want to make sure I understand you. The affiant is not the person who had knowledge of this. Is that correct?

HEARNE: The affiant had direct firsthand knowledge of the communication with the elections inspector and the document they provided them.

STEPHENS: Okay, which is generally known as hearsay, right?

HEARNE: I would not think that’s hearsay, Your Honor. That’s firsthand personal knowledge by the affiant of what she physically observed. And we included an exhibit which is a physical copy of the note that she was provided.

The two later returned to the point, after Stephens reviewed the note, and Stephens echoed Judge Diamond’s exasperation:

STEPHENS: I’m still trying to understand why this isn’t hearsay.

HEARNE: Well, it’s, it, I –

STEPHENS: I absolutely understand what the affiant says she heard someone say to her. But the truth of the matter … that you’re going for was that there was an illegal act occurring. Because other than that I don’t know what its relevancy is.

HEARNE: Right. I would say, Your Honor, in terms of the hearsay point, this is a firsthand factual statement made by Ms. Connarn, and she has made that statement based on her own firsthand physical evidence and knowledge --

STEPHENS: “I heard somebody else say something.” Tell me why that’s not hearsay. Come on, now.

HEARNE: Well it’s a firsthand statement of her physical –

STEPHENS: It’s an out-of-court statement offered where the truth of the matter is asserted, right?

In a later written decision, Stephens slammed the argument as “inadmissible hearsay within hearsay.” And after the campaign appealed, a Michigan appeals court rebuked it Monday for not including required documentation.

“I regret to inform you that your submission is defective,” the court wrote said, outlining the missing attachments.

In Chatham County, as in Michigan, the Trump campaign cited supposed evidence that 53 late ballots may have been predated so they could be counted. Except two witnesses they called acknowledged under oath that they didn’t know whether the ballots were received after the deadline. And two others for the local board of elections testified that they were, in fact, received on time.

Judge James Bass dismissed the case in a one-sentence, eight-word ruling, saying, “I’m denying the request and dismissing the petition” and abruptly adjourned the hearing. He then elaborated in a written opinion, saying that “the Court finds that there is no evidence that the ballots referenced in the petition were received after 7:00 p.m. on election day, thereby making those ballots invalid. Additionally, there is no evidence that the Chatham County Board of Elections or the Chatham County Board of Registrars has failed to comply with the law.”

The common thread running through all of these is that Trump’s lawyers are regularly offering a significantly more watered-down version of Trump’s claims about rampant voter fraud — because they, unlike Trump, have to substantiate their claims. And as these exchanges show, it’s a rather thankless task that can quickly land them on a judge’s bad side.

[Maria] Yep!

[Trump] Maybe Facebook. But it's a situation, the likes of which -- we don't have freedom of the press in this country! We have suppression by the press. They suppress. You know, you can't have a scandal if nobody reports about it. This is the greatest fraud in the history of our country from an electoral standpoint. And I guess you could build it up bigger than an electoral standpoint. What's bigger from an electoral standpoint? What's bigger than this? This is the essence of our country! This is the whole ballgame. And they cheated!

Joe Biden did not get 80 million votes! Now we were planning -- I got 63 million votes four years ago and won, quite handily in the electoral college. Won quite handily! We did very well! I got 63. We were hoping to get 69 or so, and we felt that was a path to an easy victory. I got 74 million votes, the largest in the history of a sitting president.

[Maria] Yes.

[Trump] So many millions more than we were even trying to get! And everybody said, "This is over!"

I'm telling you, at 10:00, everybody thought it was over.

[Maria] Yeah.

[Trump] And then the phony mail-in started coming in, Maria. I got 74 million votes. It was over! And then mail-in started to happen, glitches started to happen. This election was rigged! This election is a total fraud!

[Maria] Mr. President, these are obviously very serious charges, and I want to walk through them and ask you how you will prove this in the courts, because as you know, what I've been saying on the air is that, "Elections are the reason that our young men and women go on battlefields across the world and in some cases lose their lives, because they believe that their vote -- my vote -- matters just as much as your vote." And if that is not true, this is a very serious turning point for America. SO THIS IS NO LONGER ABOUT YOU, PRESIDENT TRUMP; THIS IS ABOUT AMERICA! And many people agree with you. According to Reuters, 68% of Republicans, and 28% of all Americans -- that includes Democrats -- believe there was fraud in this election. So let's go through some of the states, six states [AZ, GA, MI, NV, PA, WI] that your team is challenging. What specific strategy does your legal team take going forward? Let's start with Pennsylvania. I know that you said you have a pile of affidavits. That's part of the evidence. What other evidence can you talk about that will enable you to prove this in court in the coming weeks, Sir?

[Trump] Well, we’re trying to put the evidence in, and the judges won’t allow us to do it. We are trying – we have so much evidence. You probably saw Wednesday, last week we had a hearing in Gettysburg, Pennsylvania. It was an incredible hearing. Unbelievable witnesses! Highly respected people that were truly aggrieved. One woman came in and she wanted to vote, and they said, “No, I’m sorry, you can’t vote; you’ve already voted. Your ballot’s in.” She said, “No, no, I want to vote on November 3rd; I’ve been waiting so long to vote. I’m so proud, I want to vote.” They said, “Your ballot’s in; I’m sorry.” And that was the story. And she was aggrieved. And you have many people like that -- many, many people like that -- at a level that nobody would even believe. And that’s where it is, Maria. By the way, that’s one story out of so many different stories. You know, the poll watchers – this is true of all of the states just about that you’re talking about. I think all of them. They weren’t allowed to have poll watchers. The Democrats and Thugs, Thugs! I’m not talking about saying, “Could you please move over?” They threw them out of the counting rooms. They weren’t allowed to be in. They threw them outside in many cases. You heard the story, where the people they went out and sent for binoculars, because they wouldn’t allow them to watch. And during that period of time, a lot of bad things happened.

Then they closed – as you know – they closed up the voting! And then unexpectedly, they closed up all of the counting. Unexpectedly, new ballots came in! There were all new numbers being added. We have pictures, and we have evidence, of new ballots being brought into counting rooms. Maria, there has never been anything like this in history! And it all started with the mail-in, but it also goes to Dominion; it goes to a lot of things. But the mail-in, millions and millions of ballots being shipped all over, and ballots, as you know, there were a lot of ballots where it was just Biden on top. They didn’t do anything else, because they were in a rush.

And from what everybody is saying, and from what – I don’t think we even have to prove this – they say that I was doing so much better than they thought that they panicked, and they started just doing ballot after ballot very quickly, and just checking the Biden name on top. You see, they have all of these ballots with just one name checked. People don’t vote that way! People don’t vote that way! They want to vote against taxes, and they want to vote for judges, and they want to vote for a lot of other things you have on a ballot, you know, different races, including Congress, and they were just checked on top. Tremendous numbers of ballots like that. And that was done for the sake of speed.

We have stories that are unbelievable! But we’re not allowed to put in our proof! They say, “You don’t have standing.” I said, “I’d like to file” – to the lawyers – “I’d like to file one nice, big, beautiful lawsuit, talking about this and many other things, with tremendous proof!” We have affidavits. We have hundreds and hundreds of affidavits, like the people you saw the other day in Pennsylvania, willing to sign under penalty of perjury, you go to jail. Willing to sign. Unlike Comey who didn’t go to jail for lying, by the way, and McCabe who didn’t go to jail for lying, which is an amazing thing to me, and we may as well bring it up. But under perjury, you go to jail. We have hundreds, getting to be thousands – they’re coming in all the time – and these are respected people. These are people that are putting their lives at risk. And they don’t want to take the affidavits. And then they say we don’t have proof.

A Trump campaign attorney conceded in court on Thursday morning that he tried to enter hundreds of dodgy form-filed affidavits into evidence, even though their own investigation found that a subset of the sworn statements that they received were filled with lies and “spam.”

“This is concerning,” Judge Daniel Kiley, from Arizona’s Maricopa County, remarked with some understatement.

“How is that a reliable process of gathering evidence?” the judge asked, later blocking admission of the so-called evidence.

Put on the spot by the judge was the Trump campaign’s lawyer Kory Langhofer, who explained the automated process that reflected their post-election evidence hunt. It included an online form whose reliability Langhofer claimed was boosted by the fact that it included a CAPTCHA, which weeded out the bots. The attorneys then visited the complainants’ homes. The Trump campaign said it excluded the submissions of those who swore to lies, but they included the ones they could not prove were lying into evidence.

Judge Kiley replied that this did not show the remaining affidavits are trustworthy.

“That just shows you cannot disprove what’s asserted,” Kiley noted.

Shortly after, Langhofer went sharply off-message with Trump representatives telling any media outlet that would listen about their vast voter-fraud conspiracy theory.

“This is not a fraud case,” Langhofer said, casting the lawsuit instead as allegations of flaws within the voting system. “It is not a stealing-the-election case.”


That marked the second time in as many days that attorneys for the Trump campaign disavowed in court what the president and his loyalists alleged in print, tweets and on the public airwaves. On Wednesday, it was the campaign’s Porter Wright attorney Jonathan Goldstein who refused to allege fraud when pressed by a Pennsylvania judge.

“Your honor, accusing people of fraud is a pretty big step,” Goldstein said in Montgomery County Court of Common Pleas. “And it is rare that I call somebody a liar, and I am not calling the Board of the DNC or anybody else involved in this a liar. Everybody is coming to this with good faith.”

Over in Arizona the next day, a Maricopa lawyer played on a Trump slogan to discredit the president’s conspiracy theories. What happened in Arizona was a success story, the attorney said: “Made Maricopa County Elections Great Again.”

The Trump campaign’s admission came toward the beginning of a daylong evidentiary hearing in a case that began as the so-called “Sharpiegate” lawsuit, the outlandish speculation that election workers handed markers to Trump voters to invalidate their votes on Election Day. The hearing is expected to last for five hours.

Due to technical errors with the court’s public access phone line, proceedings went into recess for a few hours before reconvening at 12:30 p.m. Mountain Time. The judge attributed the problem’s with the system to an “external” influence, before witness testimony resumed with Maricopa County’s Director of Election Day and Emergency Voting Scott Jarrett.

Splashing more cold water on the “Sharpiegate” brouhaha, Jarrett explained that markers bleeding through a ballot did not lead to overvotes, the term for when a voter casts a ballot for more than the maximum allowable number of candidates. Jarret testified that this happened in the 2020 election mostly with 19 candidates for judges, not presidential candidates, and Arizona Attorney General Mark Brnovich (R) found no evidence of voter disenfranchisement.

Jarrett testified that Arizona reported a grand total of 191 overvotes, far short of President-elect Joe Biden’s commanding 10,000-plus vote lead.

After an evidentiary shellacking on the issue, even Langhofer abandoned the Sharpie issue. He objected to cross-examination of witnesses about the issue on grounds of relevance, saying that issue would not figure during his closing arguments. Judge Kiley overruled that objection: The questions were relevant because the witnesses spoke about the issue in their affidavits, and the Trump campaign detailed it in their lawsuit.

The Trump campaign’s parade of witnesses hardly bolstered their case.

When pressed by the Arizona Democratic Party’s counsel Daniel Arellano, each of the witnesses in turn conceded they did not know whether their vote was counted.

“Do you have any basis to believe your vote wasn’t counted?” Arellano asked voter Mia Barcello.

“Uh, I’m not sure,” Barcello replied with a laugh.

When pressed about it further, Barcello replied: “No.”

Ms. Barcello had plenty of company, with another witness responding “I couldn’t say” to the same inquiry and another replying “That’s correct” when asked if he did not know one way or another whether his vote was counted, a matter that could have been quickly settled by consulting the public record.

Not even the Trump campaign’s Arizona State elections day operations director Gina Swoboda believed otherwise—and admitted so under oath.

“I don’t know whether they were counted or not,” Swoboda said, adding that she could speak to voters’ “beliefs” but otherwise had “no way of knowing” whether or not that was true.


Testimony by the Trump campaign’s expert witness took a turn to the absurd when Zack Alcyone, whose business bio boasts of his experience in “ballot access calculations,” conceded that he is the business partner of Langhofer, the lawyer who argued the president’s case all day. The website of the Phoenix-based software company Signafide lists them as co-founders.

Sarah Gonski, another lawyer for the Arizona Democratic Party, marveled at the changing theories advanced by the Republicans.

“Your honor, it’s not exactly clear what they’re asking for because it’s been a moving target,” Gonski noted, pointing theories about Sharpies, overvotes and a green button.

The voice of Maricopa County’s lawyer Thomas Liddy swelled with indignation as he reflected upon how Arizona Republicans’ claim of “Stop the steal!” whittled down to small-bore complaints about less than 200 ballots that ultimately got counted.

“Words matter,” Liddy noted.

“The ballots are as the ballots are, voted by the voters,” he said later, adding that changing the process at this late stage would amount to “overriding voters’ intent.”


Some six hours later, with passions riding high and an anxious nation awaiting a decision, Judge Kiley adjourned the proceedings and took the matter “under advisement.” He did not commit to a date to deliver a written ruling.

I talked with several of these 'independent' lawyers/law students at length in casual, friendly conversation and, based upon their answers to basic questions about the news, it was evident that EVERY single one of the lawyers/law students that I talked to was ideologically far-left, supporting things like CHAS/CHOP in Seattle and condoning the crime skyrocketing around the country or wanting to work in Brooklyn because they support 'progressive' changes to law to 'not prosecute rioters,' etc. Yet, they all claimed to be independent. Anyway, every time a GOP staffer was removed from the room, most of the entire room would erupt in cheers and laughter and oftentimes derogatory insults as GOP Challengers were walked out by police. 11. Throughout the day I witnessed a pattern of intimidation, secrecy, and hostility by the poll workers. Poll workers would cheer, jeer and clap when poll challengers were escorted out of the TCF Center. There seemed to be collaboration between the democratic poll challengers and the City of Detroit poll workers. (Twitter)...

14. Around 4:30 p.m. chanting from outside the locked doors, and pounding on the glass erupted. At which point one of the workers I had been watching all day said in my direction "They acting like kindergarteners, I hope the police come and shoot them, like you do to us". I asked her if she was threatening violence towards me, and she mumbled something under her breath that sounded like you heard me, her coworkers started saying I was bothering them all day. Another staffer took pictures of me and literally ran away. A supervisor and a GOP attorney approached, the supervisor asked if I had witnesses, I replied everyone she was sitting with, and they sure aren't going to back me up. The supervisor said without witnesses he could not do anything. She was at ICC 2, was African American, heavy set with a white blouse ...

8. Some of the issues I witnessed in the scanning process:
• If a scanner jammed, it looked like entire batches were placed back into the machine and rescanned.
• Ballot boxes were unlocked, and unattended.
• The computers were connected to the internet and the poll workers wouldn’t let us check.
• Several ballot boxes had yellow circle stickers on them that looked similar to the yellow stickers Democratic staffers had on. When I asked the supervisor, his response was: “it’s just random, like I am bald and you have hair”
• Unidentified staff would approach with ballots to be scanned and walk away with 2 copies of a ballot.
• Poll workers would not share their names with us.
• Poll workers were allowed to wear Biden/BLM attire....

18. On numerous occasions, I was told I could only stand at the screen while democrat observers were permitted to move freely around the table.
19. When I asked a question about why a ballot was being placed in a particular box I was told I was not allowed to talk to the poll worker and did not receive an answer.
20. Democrat volunteers were verbally aggressive with me.
21. I was accused by a democrat volunteer of being part of a "cult" for my support of Trump....

20. I observed boxes with ballots in them loaded up to leave the TCF Center that were not properly sealed. I requested them to be sealed before being taken out.
21. At approximately 5:17 am I observed trays being loaded into a truck that was pulled into the TCF Center. The truck was marked Penke Truck Rentals and had Indiana license plates. In inquired what was on the trays. I was told blank ballots. Then the truck door was closed and they left....

D) I was present when poll challengers were forcibly removed from the counting room. I recall this taking place about an hour after I was informed that President Trump requested that the counting be stopped when he learned that poll challengers were being denied entry. When these ejections took place, there was a lot of shouting of approval and applause from the poll workers and election supervisors in the room....

9. I observed a Republican military ballot transfer. Poll workers refused to allow an Election Integrity Fund (EIF) challenger and me to view this transfer. All 5 poll workers were crowded around the ballot, blocking our access and refused the challenge. One of the poll workers, very irate, summoned the police to have the EIF challenger ejected. The officer said the EIF challenger was not doing anything wrong. I took the EIF challenger's place and the poll workers deliberately blocked me from viewing. Three poll workers, shoulder to shoulder, had their hands on the ballot at all times. I finally asked supervisor Yolanda to look at the ballot and transfer, and she grudgingly showed it to me....

4. I experienced intimidation the entire time from 8:30 am to 12:00 pm, that I was on the floor attempting to observe.
5. Any time I would approach a table to observe, Democratic poll challengers would block the viewing: the Democratic challengers would try to distract us from observing the information on the monitor.
6. I did attempt to speak with other Republican poll challengers to discuss how to effectively observe, but we were told we could not converse amongst ourselves.
7. If masks of Republican poll challengers slipped off their noses, they were escorted from the premesis, but if a Democratic poll challenger's masked slipped, they were allowed to stay.
8. As I was speaking with another Republican poll challenger, a woman suddenly appeared and claimed the other Republican poll challenger was "harrassing" her. He was not, he was speaking to me. The police however came and escorted him away...

3) at approx. 1:10 p I observed a ballot being duplicated at AUCB43 & I approached the supervisor and asked if there was a republican there to witness this duplication? He said he didn't know. The inspectors continued to duplicate the ballot.

I wanted to file one suit, “Donald J. Trump, President of the United States against, you know,” and put everything in one simple suit, and they say, “Sir, you do not have standing.” I say, “I don’t have standing? You mean, as President of the United States, I don’t have standing? What kind of a court system is this?”

And the judges stay away from this. There is out there, Maria, because everyone knows you gave numbers. I had a number, 79% it just came out, 79% [68] of the Republicans think the election was a fraud, and I hear 35-40% of the Democrats, but they’re not going to put it down anyway, because they’re not going to say we think it. But they all – I think most of them think it was a fraud.

[Trump] If you look at the election you have coming up right now. You’re using the same garbage machinery: Dominion. And she’s going around – Abrams – she’s going around screaming that she’s got 800 or 850,000 ballots! What kind of an election is it? She’s going around collecting votes! What kind of an election is this! What kind of a country are we living in right now where you can vote for months ahead of schedule? And then the other thing we have, and Justice Alito, I highly respected – a great man – Justice Alito seems to have big problems. But the election ended, and they gave people an extension to vote. That’s never happened before! In other words, “The election ended, but we’ll give you more time if you want to vote.” And what I understand is they didn’t think it was good either, so they back-dated all of these ballots that came in. They had people – and we have affidavits on that too – they had people back-dating ballots. And so if somebody came in the 4th or 5th or 6th, which was illegal because the legislature didn’t approve it, which everything has to be approved by the legislature, and they had judges making deals, and they had electoral officials making deals. Like this character in Georgia who is a disaster. And the governor’s done nothing! He’s done absolutely nothing! I’m ashamed that I endorsed him!

But I look at what’s going on, it’s terrible! But what happened in this election, Maria, I can’t imagine has ever happened before. They stuffed the ballot boxes. You know, I’ve been hearing that expression for many years. You have stuffed the ballot – they stuffed the ballot boxes.

[Maria] Yeah.

[Trump] And they used COVID as a means to stuff the ballot boxes. Joe Biden did not get 16 million more votes than Barack Hussein Obama. He didn’t get it! Joe Biden did not get 14 million more votes than Hillary Clinton. And by the way, he didn’t beat Obama in the black communities. You go to some of these communities where Obama is very, very popular, and he beats them in some of these communities, but all throughout the rest of the United States in a black community, he does actually poorly. He doesn’t do very well. But he beats Obama in swing states!

Now think about that. He beat Obama in swing states! You know that didn’t happen! They stuffed the ballot boxes! Everybody knows that.

[Maria] These are some of the IMPOSSIBLE STATISTICS that we have found, and this is from The Federalist article. They call it, “BIDEN MAGIC, ” and they list a number of ways that Joe Biden MAGICALLY outperformed election norms.

In the House, Kevin McCarthy is still celebrating wins in the House of Representatives. Biden also overcame your commanding primary vote. So there are certainly statistic impossibilities, and The Federalist calls it “Magic,” as you refer to. Mr. President, will you be able to prove that the computers can circumvent the controls that are in place? A lot of people say, “No, we have controls in place; there are paper ballots, the computers cannot get through the controls in place.” Can you do that?

[Scott Pelley] Though the transition has begun, President Trump remains largely holed up in the White House tweeting false accusations of a rigged election from behind a crumbling wall of lawsuits. No legal challenge, no recount, no audit has changed the outcome in any state.

Mr. Trump’s claim that millions of votes were deleted, or switched, is denied by the official he chose to secure the nation’s election systems. Christopher Krebs called the 2020 vote “the most secure in American history,” which promptly got him fired. Tonight, in his first interview since he was dismissed, Krebs tells us why he believes the vote was accurate, and why saying otherwise puts the country in danger.

[Christopher Krebs] I have confidence in the security of this election because I know the work that we’ve done for four years in support of our state and local partners. I know the work that the intelligence community has done, the Department of Defense has done, that the FBI has done, that my team has done. I know that these systems are more secure. I know, based on what we have seen that any attacks on the election were not successful.

[Scott Pelley] Two years ago President Trump put Christopher Krebs in charge of the new Cybersecurity & Infrastructure Security Agency. Krebs, a lifelong Republican, was confirmed unanimously by the Senate.

His agency, known by its acronym CISA helped secure computer systems anywhere that a security breach could be catastrophic. Nuclear power plants, for example. And the election hardware in all 50 states.

[To Christopher Krebs] Why are you speaking to us?

[Christopher Krebs] I’m not a public servant anymore, but I feel that I’ve still got some public service in me. And you know, it’s hard once you take that oath to uphold and defend the Constitution from threats foreign and domestic, it’s hard to walk away from that. And if I can reinforce or confirm for one person that the vote was secure, the election was secure, then I feel like I’ve done my job.

[Scott Pelley] Krebs, who is 43, worked on cybersecurity in the Bush administration. He became director of cybersecurity policy at Microsoft, and joined the Trump Department of Homeland Security in 2017. His priority was to stop anyone from repeating Russia’s 2016 election hacking, and disinformation.

[Christopher Krebs] So we spent something on the order of 3-1/2 years of gaming out every possible scenario for how a foreign actor could interfere with an election. Countless, countless scenarios.

[Scott Pelley] So back in 2017 as you’re looking ahead to the election in 2018 and then ultimately the election in 2020, you have a to-do list, and the to-do list includes what?

[Christopher Krebs] Paper ballots. Paper ballots give you the ability to audit, to go back and check the tape and make sure you got the count right. And that’s really one of the keys to success for a secure 2020 election. 95% of the ballots cast in the 2020 election had a paper record associated with it. Compared with 2016, about 82%.

[Scott Pelley] And with a paper record, you can go back and verify what the machine is saying by physically counting the paper.

[Christopher Krebs] That gives you the ability to prove that there was no malicious algorithm or hacked software that adjusted the tally of the vote. And just look at what happened in Georgia. Georgia has machines that tabulate the vote. They then held a hand recount, and the outcome was consistent with the machine vote.

[Scott Pelley] And that tells you what?

[Christopher Krebs] That tells you that there was no manipulation of the vote on the machine count outside. And so that pretty thoroughly, in my opinion, debunks some of these sensational claims out there that I’ve called “nonsense” and “a hoax,” that there was some hacking of these election vendors and their software in their systems across the country. It’s just “nonsense.”

[Scott Pelley] Before the election, as the President called mail-in ballots a fraud, Krebs’ team released a report highlighting the safeguards built in to mail-in voting. His agency knocked down rumors and exposed an Iranian plot to intimidate voters.

On election day, Krebs assembled a team in his command center to defend the vote.

[Christopher Krebs] We had the Department of Defense Cybercommand. We had the National Security Agency. We had the FBI. We had the Secret Service. We also had representatives from The Elections Assistance Commission which is the federal independent agency that supports the actual administration of elections. We had representatives from some of the vendors, some of the election equipment vendors, and they are critical, because they are the ones out there that know what’s going on on the ground if there’s any sort of issue with some of their systems. And we had representatives from state and local governments.

[Scott Pelley] How did the day go?

[Christopher Krebs] It was quiet, and there was no indication or evidence that there was any sort of hacking, or compromise of election systems on, before, or after November 3rd.

[Scott Pelley] And yet, this was the President November 5th.

[Scott Pelley] Nine days after election day, Mr. Trump tweeted falsely that machines from Dominion Voting Systems deleted millions of votes. Krebs couldn’t remain silent. His agency and its election security partners answered with a public statement.

[To Christopher Krebs] To quote from the November 12th statement that CISA and its partners put out: “The November 3rd election was the most secure in American history. There is no evidence that any voting system deleted or lost votes, or changed votes, or was in any way compromised.”

[Christopher Krebs] Yeah, I stand by that.

[Scott Pelley] The President tweeted out after that statement, “The recent statement by Chris Krebs on the security of the 2020 election was highly inaccurate in that there were massive improprieties and fraud.” Do you remember what the President said at the end of that tweet?

[Christopher Krebs] Oh, I was terminated? Is that – yes. I recall that.

[Scott Pelley] Were you surprised?

[Christopher Krebs] I don’t know if I was necessarily surprised. It’s not how I wanted to go out. I think I – the thing that upsets me the most about that is I didn’t get a chance to say goodbye to my team. And I’d worked with them for 3-1/2 years in the trenches, building an agency, putting CISA on the national stage. And I loved that team. And I didn’t get a chance to say goodbye. So that’s what I’m most upset about.

[Scott Pelley] Since he was fired, about a dozen Republican senators have vouched for Krebs’ work.

[To Christopher Krebs] The President is essentially saying in that tweet, that you did a lousy job, that you and your team blew it, and allowed massive fraud all across the country.

[Christopher Krebs] It was upsetting, because what I saw was a apparent attempt to undermine confidence in the election; to confuse people; to scare people. It’s not me. It’s not just CISA. It’s the tens of thousands of election workers out there that had been working non-stop, 18-hour days, for months, that are getting death-threats for trying to carry out one of our core, democratic institutions, an election. And that was, again, to me, a press conference that, it didn’t make sense. What it was actively doing was undermining democracy. And that’s dangerous.

[Scott Pelley] Let me ask for your reaction to some of the vote fraud that the President and his team have been alleging. “Votes tabulated in foreign countries.”

[Christopher Krebs] So, [expostulates] all votes in the United States of America are counted in the United States of America. I don’t, I don’t understand this claim; all votes in the United States of America are counted in the United States of America. Period.

[Scott Pelley] “Voting machines corrupted by mysterious actors in Venezuela.”

[Christopher Krebs] So, again, there’s no evidence that any machine that I’m aware of has been manipulated by a foreign power. Period.

[Christopher Krebs] Look, I think we can go on and on with all the farcical claims alleging interference in the 2020 election, but the proof is in the ballots. The recounts are consistent with the initial count, and to me that’s further evidence, that’s confirmation that the systems used in the 2020 election performed as expected, and the American people should have 100% confidence in their vote.

[Scott Pelley] In a news conference, a lawyer who was representing the President at the time, Sidney Powell, said specifically, that the Dominion Company’s voting machines,

[Sidney Powell] “It can set and run an algorithm that probably ran all over the country to take a certain percentage of votes from President Trump and flip them to President Biden.”

[Christopher Krebs] Votes were cast in Georgia, for instance, again, on paper. They were counted by a machine. They were subsequently recounted by hand. The outcomes of that count were consistent. If there was an algorithm that was flipping votes, or changing votes, it didn’t work! I think the more likely explanation though is that there was no algorithm, that the systems performed as intended, that the series of security controls before, during and after an election, protected those systems from any sort of misbehavior.

[Scott Pelley] Most elections are run by each state’s Secretary of State. But not one of them, Democrat or Republican, has reported ballot rigging that would change the election. Some are paying a price for integrity.

[Christopher Krebs] And it’s, in my view, a travesty what’s happening right now with all these death threats to election officials and secretaries of state. I want everybody to look at Secretary Boockvar of Pennsylvania, Secretary Benson in Michigan, Secretary Cegavske of Nevada, Secretary Hobbs in Arizona – all strong women that are standing up, that are under attack from all sides, and they are defending democracy. They are doing their jobs. Look at Secretary Raffensperger in Georgia, a lifelong Republican. He put country before party and is holding a free and fair election in that state. There are some real heroes out there. There’s some real patriots.

[Scott Pelley] At the Capitol, the stage is going up for inauguration day, January 20th. Well before that, on December 14th, the presidential electors will cast their ballots, which should settle the election. Christopher Krebs told us it’s ironic that the disruption and disinformation he feared from abroad came instead from Pennsylvania Avenue.

[To Christopher Krebs] The President says you’re dead wrong about election security, and to him you say what?

[Christopher Krebs] There’s no foreign power that is flipping votes. There’s no domestic actor flipping votes. I did it right. We did it right. This was a secure election.

And secondly, in terms of Pennsylvania, your team got a blow on Friday, an Appeals Court rejecting a request to block the certification of Pennsylvania’s election results. Your attorneys have said they will appeal to the Supreme Court. Give us your timing on that! Will you get a different outcome in the next couple of days? Will we be hearing a victory in Pennsylvania in the next couple of days?

[Trump] Okay, well let me just talk about the Federalist paper, just for a second, because you mentioned it. There are five points. And it was written brilliantly, but sarcastically. Because they were saying he must be a great campaigner because he lost here, he lost here, he lost here, and he won the election. If a President – this is over a long, many period, hundreds of years, a hundred years, or something, they went into all the elections. If you win one of the five points – I won all five – if you win one of the five points, you become President, automatically, a sitting President gets reelected. I won all five and I still lost. There’s only one reason for that: FRAUD! STUFFING THE BALLOT BOXES! All of the things they did. There’s only one reason. And everybody knows it. And your numbers are much different. I mean, this country – I cannot believe it – there’s more spirit, I see more spirit right now! This country cannot have fake elections like we have fake news, like we have all of the things happening with Big Tech. I mean, there’s a tremendous move on to repeal Section 230. Big Tech has no liability. They can do whatever they want. It’s ridiculous! But there’s a big move to do that. I don’t know if the politicians have the guts to do it, but they are hurting themselves very badly. There are so many different things.

Yeah, we’ll be appealing different cases, Maria. You know, it’s not only OUR case. Mike Kelly, great Congressman, as you know, from Pennsylvania, has a great case. He won -- well, he had a good decision, then he went a step above and they turned him down. I think that was in Pennsylvania. I think he’s got a great appeal to the United States Supreme Court. Act 77 where the legislature is supposed to approve all this stuff. And they had it approved by local officials or a judge. I think it’s a great case. But I’m sure they’ll be appealing, too. They have a fantastic case. You know, a lot of the cases that have been lost haven’t been OUR cases. They are people who are aggrieved, who went out and filed lawsuits because they saw things happening that they’ve never seen before. A poll watcher – I have a lot of respect for Ken Starr. And I watched him on your show, actually. And a poll watcher is like a sacred person in the world of politics. They watch, they watch – they call them partisan poll, because they are like a Republican poll watcher, a Democrat poll watcher. They watch the votes being counted. It is so important. It is like the most important – otherwise, you know, people will cheat, unfortunately.

So poll watchers are very important. Our poll watchers didn’t just get set back, which they did. They got thrown out of buildings in different states. AND THIS IS A WELL COORDINATED ATTACK! Because you don’t do it with everybody. Maybe it would happen in Philadelphia, but it wouldn’t happen in Detroit.

Now, Detroit and Philadelphia, Milwaukee, these are among the most dishonest political places in use. Just look at the past history. I’m not being rude to anybody. These are highly corrupt places politically. But poll watchers were walked out by thugs out of the building. And you have it all over the news. We could give you everything you need, all you have to do is local news covers it actually much differently than national news. National news doesn’t like covering anything that would be like that. They do not report the news. That’s why I call them “Fake News.” But they’ve never been fake like they are now. Now they are a disgrace. But the News is the enemy. But if you take out the contested swing states’ electoral votes, you’re back down to President Trump having 232 electoral votes, and Joe Biden having 227. That is if you strip out the six states with the legal challenges.

[Trump] That’s right!

[Maria] So is the thinking here that because of the various ballot issues, that the Supreme Court will rule that the vote is tainted. And that will mean that they have to take votes away from Biden and not certify? Is that the thinking?

And secondly, what is your timing on this, Mr. President? Because we’ve got some notable election dates here that I want to ask you what you believe you consider to be your drop dead date in terms of proving this case. Is it December 18th when the states finalize elector appointments, or when electors cast votes in each state? Is it the Vice President receiving electoral votes? Is it the House and Senate counting electoral votes? Or is it inauguration day, January 20? How do you see it?

[Trump] Well, I don’t want to give you an actual date. A lot of people say the 18th, or they say the 14th, or they say January 20th. I’m not going to say a date. But I will say we have to move very fast. We have been moving fast. And look, when you say, “Is it tainted?” Everyone knows it’s tainted. Everyone knows that the poll watchers were thrown out of buildings. Everyone knows that people were not allowed to vote when they walked in, SO PRECIOUSLY, SO BEAUTIFULLY, TO VOTE. An elderly woman – we have her deposition – was told, WHO LONGED TO VOTE, WHO LOOKED FORWARD TO THE DAY, NOVEMBER 3RD, was told when she got in there, “I’m sorry, you voted.” And then they gave her another ballot to sign which they don’t use, because she already voted. That’s how brazen they are! They’ll actually vote people knowing there’s a good chance that those people will come. And there were thousands of those people!

And by the way, just to set the record straight, because a couple of these cases were dismissed because they didn’t have enough votes, enough bad, tainted votes, so that you don’t overturn the state. No! In all cases, we have many times – I don’t even know where the judges would have gotten that information. We have thousands and thousands and tens of thousands of votes more than we need. In other words, if I lost a state by 9,000 votes, or if I lost Georgia by let’s say 12,000 votes, we have tens of thousands more votes than that. We don’t have it where we found nine dead people, and therefore we want you to turn over the state and give us those electoral votes. In all cases, and yet judges are, one judge was saying we didn’t have the votes to turn it over; therefore, it’s meaningless. In other words, if you don’t have the votes, I understand that. If you had far fewer votes than the amount.

Now, in one way, you could also say, “It’s so fraudulent when they are voting for dead people, and when dead people are signing applications, meaning they’re not, meaning somebody else is fraudulently signing, I mean, in the name of a dead person! Well, that tells you a lot! But we actually have thousands of votes, in some cases hundreds of thousands of votes, more than we need in every swing state that we’re talking about.

[Maria] Mr. President, have you received from your Chief of Cybercommand any briefing on electronic interference from either internal or external influences? Have your received this briefing?

[Trump] We’re dealing with John Radcliffe, who is fantastic. We’re dealing with other people. And we don’t always get – you know, they’ve been there for a long time, Maria. It’s a long story! It’s a long story! We’re disappointed that other people, more people didn’t get involved, because this is a fraud. This is a fraud against the American people. It’s a fraud against the United States of America. And we’re disappointed that some people don’t get more involved, like this character on 60 Minutes, they’re putting him on – this guy, we had so many things. He’s talking about how honest the election is. Well, how come there are thousands of dead people voting? How come there are all of these other people voting that shouldn’t be voting?

(CNN) To hear some people tell it -- including a handful of prominent Republicans, such as members of President Trump's family and supporters like former House Speaker Newt Gingrich and former acting Director of National Intelligence Richard Grenell -- you might think that Democrats were using dead people to steal Michigan's Electoral College votes from Trump.

But, like much of the misinformation circulated online this week by some Trump supporters, the claim falls apart under scrutiny. A CNN analysis of the claim and the purported backing for it did not find a single instance of that happening.

One of the supposed pieces of evidence was a list that circulated on Twitter Thursday evening allegedly containing names, birth dates, and zip codes for registered voters in Michigan. The origin of the list and the identity of the person who first made it public are not known.

CNN examined 50 of the more than 14,000 names on the list by taking the first 25 names on the list and then 25 more picked at random. We ran the names through Michigan's Voter Information database to see if they requested or returned a ballot. We then checked the names against publicly available records to see if they were indeed dead.

Of the 50, 37 were indeed dead and had not voted, according to the voter information database. Five people out of the 50 had voted -- and they are all still alive, according to public records accessed by CNN. The remaining eight are also alive but didn't vote.

The sample CNN reviewed is not representative, but the trend was clear -- not a single one of the names examined was of a dead person voting.

The version of the list CNN found has since been removed from the site hosting it.


Viral videos

Falsehoods about dead people casting ballots in Michigan began spreading through videos posted to social media late Wednesday night.

A typical clip showed a person entering a name, birth date and zip code into Michigan's state-run voter lookup website. The videos would show the search results for a voter who, despite being over 110 years old, had supposedly requested and successfully returned a ballot.

Right-wing personality Austen Fletcher, who goes by the name "Fleccas" online, created some of the videos that went viral.

Fletcher's first video, posted shortly after midnight Thursday morning, shows him search for a voter named William Bradley who was born in March 1902.

"Turns out 118-year-old 'William Bradley' voted via absentee ballot in Wayne County, Michigan," Fletcher tweeted Thursday. "How long has this been going on?" he added.

A search of public records revealed a man named William Bradley was born in March 1902 and died in I984 in Michigan's Wayne County. But public records also show that his son, also named William Bradley and living at the same address, is very much alive -- and a voter.

Lawrence Garcia, the principal attorney for the city of Detroit, confirmed to CNN that "a man with a nearly identical name [to the deceased Bradley] requested a ballot and voted properly in both the primary and general elections."

"When his ballot was initially logged, however, it was incorrectly attributed to the William Bradley born 118 years ago through a clerical error," Garcia added.


The younger Bradley told PolitFact that he reached out to the city after Fletcher's video was posted but was told not to worry since officials check for a matching signature and date of birth.

Some prominent figures on the right, including Donald Trump Jr, actor James Woods, and activist Candace Owens shared Fletcher's videos, which have collectively garnered millions of views across Twitter.

Others, like Juan Andres Caro, a White House policy adviser, made their own videos replicating Fletcher's search.

Grenell retweeted Caro's video, which has more than a million views on Twitter.

CNN reached out to Fletcher and Caro for comment. Fletcher did not respond and Caro did not comment.

Tracy Wimmer, the director of media relations for Michigan's Secretary of State, told CNN that, on rare occasions, errors like this can occur with "voters with similar names, where the ballot is accidentally recorded as voted by John Smith Sr when it was actually voted by John Smith Jr."

She added that ballots for deceased voters are rejected and that "local clerks can correct the issue when it is brought to their attention."

Later on November 5, the Michigan Secretary of State's office replied directly to Fletcher's tweet, calling it "misinformation." By then the post had been retweeted tens of thousands of times.

Errors and quirks

Clerical errors, database quirks, and genuinely long-living individuals can sometimes explain why it looks like people are casting ballots from beyond the grave.

Occasionally living voters submit ballots with incorrect birth years that make it appear as if they're actually deceased, according to Wimmer. "In such scenarios, no one ineligible has actually voted," she said.

Other videos Fletcher produced feature voters who returned ballots and are listed in Michigan's voter information website as having been born in January 1900 or 1901.

Of course, that's not what happened. There's a much simpler and less sinister explanation.

Detroit's Director of Elections, George Azzouz explained to CNN that "the date of January 1, 1900 is often used in the electronic poll book as a temporary placeholder for absentee ballots arriving just before Election Day."

"The placeholder information has to be inserted in order for the electronic poll book to accept the entry," Azzouz added.

A 2017 report about duplicate voting from the Government Accountability Institute echoed this explanation as well.

"It is important to note that some state registration systems indicate a missing date of birth by adopting filler dates, such as 01/01/1900, 01/01/1850, or 01/01/1800," the report noted.

"The vast majority of votes cast by individuals appearing to be over 115 years old had these three erroneous birthdates."


A search of public records for a different voter Fletcher featured in his videos supports this. Donna Brydges, despite being 75 years old, has a voter registration entry with a 1901 year of birth.

Catherine Lewis, the clerk for the township where Brydges lives, explained to CNN that "it is not uncommon for voters in Michigan to have 01/01/01 mistakenly listed as their date of birth in the qualified voter database."

"The voter in question properly applied for an absentee ballot, provided her state-issued driver's license with her application, and returned her absentee ballot in the properly signed and sealed envelope as required by state law," Lewis said in a statement.

"The board of election inspectors, consisting of Republican and Democratic members, had no question that the voter was who she purported to be or that her signatures matched," she added.

The fact that these birthdates showed up repeatedly by itself should have been a clue. After all, if someone wanted to steal an election using votes from dead people without getting caught, it would be silly to pick people who all happened to have been born in the same month and year, not to mention people whose incredibly advanced age would immediately raise suspicion.

Why the dead don't vote

The Michigan Secretary of State's office says casting a vote in the name of a dead person is almost impossible.

"In the unlikely event that someone who was alive and had their identity verified when they requested a ballot died before receiving it, and someone else attempted to vote as them, the signature mismatch/deceased flag in the [Qualified Voter File] would once again flag it for rejection," Wimmer explained.

In fact, CNN previously reported on a 20-year-old cancer patient in Wisconsin who voted early but sadly died before election day. Her vote was thrown out under Wisconsin law.

This assessment is backed up by research from independent organizations like the Brennan Center for Justice, a nonpartisan but liberal-leaning law and policy institute.

"The consensus from credible research and investigation is that the rate of illegal voting is extremely rare, and the incidence of certain types of fraud -- such as impersonating another voter -- is virtually nonexistent," the institute notes in the resources section of their website.

How come we find thousands of votes? How come poll watchers – every vote that went through an election area, they call it a counting area, where our poll watchers were locked out of the building, outside, standing outside, or standing so far away that you couldn’t see, where they literally went out and sent for binoculars. These are supposed to be right next to that vote. Well, every one of them is a fraud. So how can he say, other than that he’s an anti-Trumper, how can this guy say there was no fraud? 60 Minutes, by the way, never called us for comment. You know, they do a piece on somebody, they don’t call us for comment. But when you don’t have a poll watcher, and thousands of votes are passing that area where you’re supposed to have a poll watcher to see that everything’s on the up and up, well, those are votes that count toward us. And those are thousands of votes. And they were done in many of the states, swing states that we are talking about.

[Maria] Where is the DOJ and the FBI on all of this? Mr. President, you have laid out some serious charges here. Shouldn’t this be something that the FBI is investigating? Are they? Is the DOJ investigating?

[Trump] Missing in action. I can’t tell you where they are. I ask, “Are they looking at it?” Everyone says, “Yes, they’re looking at it.” Look, where are they with Comey, McCabe, and all of these other people? You know, I said, “I’ll stay out of it.” I wish I didn’t make that statement. There’s no reason really why I have to. But where are they with Comey, with McCabe, with Brennan, with all these people who lied to Congress. They lied, they leaked, they spied on our campaign, and I see Carter Page is bringing a lawsuit – that’s good news. Where are they with all of this stuff? And you know, what happened to Durham? Where’s Durham? So, you know, you’re asking me a question. These people have been there a long time. And I know FBI, and FBI is great at the levels that we talk about, but it’s inconceivable. You would think, if you’re in the FBI or Department of Justice, this is the biggest thing you could be looking at. Where are they? I’m not seeing anything! I mean, I just, they just keep moving along, and they go on to the next president. They’ve been there for a long time. People don’t understand this. They’ve been there for a long time. Some of them have served a lot of different presidents. And they have their own views.

All I can say is I haven’t heard, with all of the fraud that’s taken place, nobody has come to me and said, “Oh, the FBI has nabbed the people who are doing this scheme.” The FBI is looking at Dominion – which nobody even knows where they are based – which nobody even knows where the votes are counted. Do you know, the votes in Dominion, they say are counted in foreign countries. Okay? Can you believe this?

Now, Dominion is also based in a number of foreign countries. One of them is Canada. And Canada refuses to use Dominion, and they are based there. They won’t get anywhere near. Texas will not get anywhere near Dominion. I spoke with the attorney general; I spoke with a lot of different people. Texas, you should see the reports Texas wrote on Dominion. They wouldn’t use them. They wouldn’t under any circumstance they wouldn’t use them. So as you have probably heard. But Canada does paper votes. And the only way this is going to be safe is paper votes. Even the mailman. Look, the mailmen are carrying thousands of ballots back and forth, back and forth. There are many mailmen who are in big trouble right now for selling ballots, for getting rid of ballots. This is the craziest thing you’ve ever seen.

[Maria] Well, it seems to me –

[Trump] But many ballots with the name Trump on them were thrown out. You’ve read that. They’ve found ballots in a river, with the name Trump on them from the military. They were signed. And they were floating in a river.

No absentee ballots in the key battleground state of Wisconsin were found in rivers last week, and though local authorities reported some absentee ballots were temporarily lost in a batch of mail found on the side of the road near Appleton, Wisconsin, none of the ballots were from the state, the Wisconsin Elections Commission said on Thursday.

Unanswered questions about what happened to the batch of mail found in eastern Wisconsin are likely to be addressed by an ongoing Postal Service investigation, but the incident has come under intense and perhaps premature scrutiny because of unsubstantiated claims the president made during the first presidential debate on Tuesday, when he said that mail-in ballots were being "dumped in rivers."

"Did you see what's going on?" Trump said onstage. "They are being dumped in rivers. This is a horrible thing for our country."

"There is no evidence of that," responded Democratic nominee Joe Biden.

White House press secretary Kayleigh McEnany later made it clear that Trump was talking about the investigation in Wisconsin.

McEnany was repeatedly pressed by a reporter on Thursday to clarify where the "river" that Trump talked about was located, but she declined to answer.

"You're missing the forest through the trees here," she responded to the reporter.

The lost mail in Wisconsin was actually found on the side of a road and in a ditch line in Greenville, Wisconsin, a small town of about 12,000 people outside the city of Appleton. The mail was supposed to be in transit to the post office, according to the Outagamie County Sheriff's office. "Several" absentee ballots were found among three "trays" of mail, according to the sheriff's office.

Outagamie County Sheriff's Office Lt. Ryan Carpenter described each "tray" as about 18-inches high with an estimated few hundred pieces of mail. Officers who reported to the scene didn't count how many absentee ballots were in the mix, Carpenter said.

The U.S. Postal Service, which is in charge of the investigation going forward, declined to comment, but Wisconsin Elections Commission administrator Meagan Wolfe announced on Thursday that she'd been informed by post office officials that no Wisconsin ballots were among the lost mail.

Wolfe said she was not informed what state the ballots were from.

"There was mail found outside of Appleton, and that mail did not contain any Wisconsin ballots, no Wisconsin ballots were part of what was found, no Wisconsin ballots were involved or impacted by the incident," Wolfe said Thursday afternoon.

"But if there were ever an issue with Wisconsin ballot, it's a very intentional, deliberate process with many safeguards in place, where we would be able to identify issues," Wolfe added.

Wisconsin began sending out absentee ballots to voters on Sept. 17. The state is a vital win for either candidate in the path to victory this November.

Greenville town clerk Wendy Helgeson said she hopes USPS investigators can offer clear information to the public sooner rather than later, so as not to undermine the integrity of the process.

"If there's one thing that I would hope that people know about our state is that there's a huge amount of integrity in the job that we do, and people take a lot of pride in it, nobody wants to be in the newspaper," Helgeson said.

Trump's claims about fraud in the mail-in ballot process have grown as the country nears Election Day, which is about a month away, but there is no evidence that voter fraud will increase as mail-in voting becomes a more popular choice due to the pandemic.

Election officials in Democrat and Republican states alike have been clear that they have confidence in their election process, and experts agree that the risk of fraud is very low.

"There is no evidence that widespread or systematic absentee voter fraud is a real phenomenon. There have been scattered instances of both in-person and absentee voter fraud throughout history. But that's something that both Democratic and Republican campaigns have engaged in. And there is just no evidence that it happens on a widespread or systematic basis," said Kate Shaw, law professor at Cardozo Law School and ABC News legal contributor.

And for voters both in Wisconsin and across the country who don't want to rely on the mail to vote this year, there are other ways to safely cast a ballot without increasing the risk of contracting coronavirus. In many states, early voting or absentee in-person voting is an option, which allows voters to cast their ballots in person ahead of Election Day. There are also drop boxes, where voters can drop their absentee ballots off directly with their election clerks instead of sending it through the mail.

In Wisconsin, voters have already started receiving and returning absentee ballots at a rate that far surpasses what was seen in 2016: 1.2 million absentee ballots have been requested as of Oct. 1, per the Wisconsin Elections Commission, which is 16 times more ballots than were requested by this time last year. Already, 395,000 ballots have been returned, which is seven times more than the same time last year.

The deadline to request an absentee ballot in Wisconsin is Oct. 29, but voters should give themselves at least a week before the Nov. 3 deadline to return it by mail. Voters can also submit their ballots to a dropbox, vote absentee in-person with their ballot at a clerk's office beginning on Oct. 20, or vote in person on Election Day.

No matter how Wisconsin voters choose to cast their absentee ballots, they can track their ballots online through the whole process. Each Wisconsin absentee ballot has an intelligent barcode, so its movements can be tracked much like an Amazon package.

On September 10, Nora Dannehy resigned as the deputy to John Durham, the federal prosecutor investigating the government’s probe into the Trump campaign and Russia during the 2016 election. Dannehy left her post and the Justice Department in part because of Attorney General William Barr’s pressure on Durham to release a report on his investigation’s findings before Election Day, according to a person familiar with her thinking. Trump had long been hoping a report out this fall would damage Democrats, including Joe Biden, and help him win reelection. In Trump’s terminology, Durham’s report would reveal an “attempted overthrow” of his administration by Democratic insiders. But Justice Department guidelines restrict prosecutors from taking such actions within 60 days of an election because they might affect the outcome of the election. Both Durham and Dannehy believed that if they complied with Barr’s demands they would be violating this doctrine, according to two people familiar with their thinking.

Durham, who is the U.S. Attorney for Connecticut, and Dannehy were also troubled that Barr had purposely misrepresented their work in numerous public comments, the two people said. According to two sources familiar with the probe, there has been no evidence found, after 18 months of investigation, to support Barr’s claims that Trump was targeted by politically biased Obama officials to prevent his election. (The probe remains ongoing.) In fact, the sources said, the Durham investigation has so far uncovered no evidence of any wrongdoing by Biden or Barack Obama, or that they were even involved with the Russia investigation. There “was no evidence … not even remotely … indicating Obama or Biden did anything wrong,” as one person put it.

Shortly after the resignation of his prized deputy and with the election looming on the horizon, Durham phoned Barr. He forcefully told the attorney general that his office would not be releasing a report or taking any other significant public actions before Election Day, according to a person with knowledge of the phone call. Dannehy’s resignation constituted an implied but unspoken threat to Barr that Durham or others on his team might resign if the attorney general attempted to force the issue, according to a person familiar with Durham’s thinking.

After hearing from Durham in September, Barr informed the president and allies that there would be no October surprise, causing Trump to lash out. “Unless Bill Barr indicts these people for crimes — the greatest political crimes in the history of our country — then we’re going to get little satisfaction unless I win,” he told Fox Business last month. “[These] people should be indicted, this was the greatest political crime in the history of our country. And that includes Obama and it includes Biden.”


The president had been hoping for a repeat of what happened during the 2016 election, when, with just 11 days left, then-FBI director James Comey announced the reopening of the bureau’s Hillary Clinton email investigation. Comey’s decision is widely seen to have hurt Clinton at a crucial moment and helped Trump pull off a come-from-behind victory. For more than a year and a half, Trump believed that Durham’s investigation would confirm the conspiracy theory that the “deep state” — senior officials of the Justice Department, FBI, and intelligence community — had worked to sabotage his presidency with false accusations that he had colluded with Russia. The Justice Department’s inspector general last year reported finding no “evidence that political bias or improper motivation influenced the decisions” of the Russia investigators, and so far, the only charge brought by Durham’s office has been against an ex-FBI lawyer who pleaded guilty to falsifying an email used to obtain a warrant for electronic surveillance on former Trump campaign aide Carter Page.

For his part, Barr was hyping what the Durham investigation would find since at least the spring and suggested it would be bad for Democrats. “There is a difference between an abuse of power and a federal crime. Not every abuse of power, no matter how outrageous, is a federal crime,” Barr told reporters in May. “As to President Obama and Vice-President Biden, whatever their level of involvement, based on the information I have today, I don’t expect Mr. Durham’s work will lead to a criminal investigation of either man. Our concern over potential criminality is focused on others.” One person familiar with the Durham investigation called Barr’s comments a backhanded attempt to insinuate that Obama and Biden had abused their powers. Barr’s ongoing commentary regarding Durham’s investigation appears to have violated Justice Department policy that officials should “not confirm the existence or otherwise comment about ongoing investigations.”

While discussing Durham’s investigation, Barr’s rhetoric also increasingly paralleled Trump’s. In contrast to the president, Barr delivered his comments in a measured and restrained manner, while Trump’s claims have been coarse and hyperbolic. Barr has suggested that the DOJ and FBI’s investigations of the president was “one of the greatest travesties” in American history and a “bogus scandal,” whereas Trump simply called the investigations a “hoax.” Barr has said the “greatest danger to our free system” is when law enforcement and intelligence agencies try to “affect the outcome of an election.” Trump accused them of an attempted “coup” against him. Barr has said that the “completely bogus narrative” caused by the investigations “was largely fanned and hyped by a completely irresponsible press.” Trump blamed the “fake media,” period.

After hearing there would be no October surprise, Trump excoriated Barr, telling Rush Limbaugh: “I think it’s a terrible thing, and I’ll say it to his face.”

In a press conference Thursday, President Donald Trump’s personal lawyer, Rudy Giuliani, claimed to have evidence of voter fraud in Michigan based on sworn affidavits from four individuals. According to Giuliani, those four affiants reported seeing "thousands and thousands" of Biden ballots in what appeared to be a food truck hauled into the Detroit, Michigan polling center at 4:30 a.m after all Republican inspectors had left the site.

"What they swear to is that at 4:30 in the morning a truck pulled up to the Detroit center where they were counting ballots. The people thought it was food so they all ran to the truck. Wasn't food. It was thousands and thousands of ballots," Giuliani said.

In a ruling on November 13, Judge Timothy Kenny of the Third Judicial Circuit Court of Michigan invalidated the affidavits Giuliani mentioned. The judge ruled that the claims regarding the nature and quantity of the ballots were speculations at best and sinister at worst.

Republican challenger Andrew Sitto implied the "tens of thousands of ballots" he saw cast for former vice president Joe Biden were proof of fraud, but the judge considered those ballots "not surprising."

"It is not surprising that many of the votes being observed by Mr. Sitto were votes cast for Mr. Biden in light of the fact that former Vice President Biden received approximately 220,000 more votes than President Trump," Judge Kenny wrote in his ruling.

Sitto also suggested that the batch of ballots referenced previously were somehow different because they were brought in through the back from vehicles with out-of-state license plates.

State Elections Director Christopher Thomas, who was present at the TCF Center in Detroit where ballots were being counted, refuted the allegations in an affidavit submitted to the judge and cited in the ruling. According to the judge’s ruling, Thomas stated that all ballots delivered to the center were brought in through the back and that Detroit employed out-of-state rental trucks to deliver them.

The Secret Service filed charges against a Maryland man after he threatened to kidnap and kill Democratic presidential nominee Joe Biden and vice presidential nominee Kamala Harris.

A criminal complaint filed by the agency Wednesday said a man identified as James Dale Reed on Oct. 4 approached a house in his hometown of Frederick that had Biden-Harris lawn signs posted and left a handwritten note detailing graphic threats against the candidates and their supporters.

The man was identified after the resident’s video doorbell captured Reed allegedly leaving the note at the home’s doorstep, according to the complaint.

Reed allegedly threatens in the letter to “severely beat” Biden to “the point of death” and shoot Harris in the head with a Glock 17 pistol. The letter also includes a graphic threat of sexual assault against Harris.

The letter says Biden-Harris supporters would also be “targeted.”

“We have a list of homes and addresses by your election signs,” the letter reads, without clarifying who constitutes “we.” “We are the ones with these scary guns, we are the ones your children have nightmares about.”


The Secret Service’s criminal complaint did not detail any steps Reed or anyone else took to fulfill the alleged threat.

The agency said it focused on Reed following an anonymous tip. He first denied writing the threatening letter when he was first interviewed on Oct. 13, but later admitted to authoring it after providing elimination palm prints and a handwriting sample on Oct. 15.

He later told authorities “this will happen,” referring to threatening comments, citing the tense political climate.

Reed is charged with the federal offense of threatening a major candidate, which can be punished by up to five years in prison. He’s also facing state charges of threatening mass violence and voter intimidation.


The Maryland resident had come to the Secret Service’s attention in 2014 after making a threat then against a person under its protection.

The Biden campaign did not immediately respond to a request for comment from The Hill.

They have a great case, because the legislature didn’t make the decision on this stuff. And they have a great case. But you have to appeal it. The big thing is can you get it? PHILADELPHIA (AP) — As they frantically searched for ways to salvage President Donald Trump’s failed reelection bid, his campaign pursued a dizzying game of legal hopscotch across six states that centered on the biggest prize of all: Pennsylvania.

The strategy may have played well in front of television cameras and on talk radio to Trump’s supporters. But it has proved a disaster in court, where judges uniformly rejected their claims of vote fraud and found the campaign’s legal work amateurish.

In a scathing ruling late Saturday, U.S. District Judge Matthew Brann — a Republican and Federalist Society member in central Pennsylvania — compared the campaign’s legal arguments to “Frankenstein’s Monster,” concluding that Trump’s team offered only “speculative accusations,” not proof of rampant corruption.

The campaign on Sunday filed notice it would appeal the decision to the 3rd U.S. Circuit Court of Appeals, a day before the state’s 67 counties are set to certify their results and send them to state officials. And they asked Sunday night for an expedited hearing Wednesday as they seek to amend the Pennsylvania lawsuit that Brann dismissed.

Trump’s efforts in Pennsylvania show how far he is willing to push baseless theories of widespread voter fraud, even as the legal doors close on his attempts to have courts do what voters would not do on Election Day and deliver him a second term.

The effort is being led by Rudy Giuliani, Trump’s personal lawyer, who descended on the state the Saturday after the Nov. 3 election as the count dragged on and the president played golf. Summoning reporters to a scruffy, far-flung corner of Philadelphia on Nov. 7, he held forth at a site that would soon become legendary: Four Seasons Total Landscaping.

The 11:30 a.m. news conference was doomed from the start.

Only minutes earlier, news outlets had started calling the presidential contest for Democrat Joe Biden. The race was over.

Just heating up was Trump’s plan to subvert the election through litigation and howls of fraud — the same tactic he had used to stave off losses in the business world. And it would soon spread far beyond Pennsylvania.

“Some of the ballots looked suspicious,” Giuliani, 76, said of the vote count in Philadelphia as he stood behind a chain link fence, next to a sex shop. He maligned the city as being run by a “decrepit Democratic machine.”

“Those mail-in ballots could have been written the day before, by the Democratic Party hacks that were all over the convention center,” Giuliani said. He promised to file a new round of lawsuits. He rambled.

“This is a very, very strong case,” he asserted.

Justin Levitt, a Loyola Law School professor who specializes in election law, called the Trump lawsuits dangerous.

“It is a sideshow, but it’s a harmful sideshow,” Levitt said. “It’s a toxic sideshow. The continuing baseless, evidence-free claims of alternative facts are actually having an effect on a substantial number of Americans. They are creating the conditions for elections not to work in the future.”

Not a single court has found merit in the core legal claims, but that did not stop Trump’s team from firing off nearly two dozen legal challenges to Biden’s victory in Pennsylvania, including an early morning suit on Election Day filed by a once-imprisoned lawyer.

The president’s lawyers fought the three-day grace period for mail-in ballots to arrive. They complained they weren’t being let in to observe the vote count. They said Democratic counties unfairly let voters fix mistakes on their ballot envelopes. Everywhere they turned, they said, they sniffed fraud.

“I felt insidious fraud going on,” Philadelphia poll watcher Lisette Tarragano said when Giuliani called her to the microphone at the landscaping company.

In fact, a Republican runs the city’s election board, and has said his office got death threats as Trump’s rants about the election intensified. No judges ever found any evidence of election fraud in Pennsylvania or any other state where the campaign sued — not in Michigan, Wisconsin, Arizona, Nevada or Georgia.

Instead, Trump lawyers found themselves backpedaling when pressed in court for admissible evidence, or dropping out when they were accused of helping derail the democratic process.

“I am asking you as a member of the bar of this court, are people representing the Donald J. Trump for president (campaign) … in that room?” U.S. District Judge Paul Diamond asked at an after-hours hearing on Nov. 5, when Republicans asked him to stop the vote count in Philadelphia over their alleged banishment.

“There’s a nonzero number of people in the room,” lawyer Jerome Marcus replied.


The count continued in Philadelphia. The Trump losses kept coming. By Friday, Nov. 6, when a state appeals court rejected a Republican complaint over provisional ballots and a Philadelphia judge refused to throw out 8,300 mail-in ballots they challenged, Biden was up by about 27,000 votes.

Nationally, the race had not yet been called. But it was becoming clear that a Biden win in Pennsylvania, with its 20 electoral votes, was imminent.

When it came, Trump quickly pivoted to litigation. It did not go well.

A U.S. appeals court found Pennsylvania’s three-day extension for mail-in ballots laudatory, given the disruption and mail delays cause by the pandemic. Judges in Michigan and Arizona, finding no evidence of fraud, refused to block the certification of county vote tallies. Law firms representing the campaign started to come under fire and withdrew.

That left Giuliani, who had not argued a case in court for three decades, in charge of the effort to overturn the election.

“You can say a lot at a driveway (news conference). ... When you go to court, you can’t,” said lawyer Mark Aronchick, who represented election officials in Philadelphia, Pittsburgh and elsewhere in several of the Pennsylvania suits. “I don’t really pay attention to the chatter until I see a legal brief.”

On Tuesday, Giuliani stepped into the courtroom. He was a late addition to the docket after election lawyers from Porter Wright Morris & Arthur had bowed out over the previous weekend. He had an entourage in tow, a show of force that had everything but a compelling legal argument.

Giuliani asked Brann to hold up the certification of the state’s 6.8 million ballots over two Republican voters whose mail-in ballots were tossed over technical errors.

“I sat dumbfounded listening,” said Aronchick, a seasoned trial lawyer.

“We were ready to argue the one count. Instead, he treated us to an even more expanded version of his Total Landscaping press conference,” Aronchick said. “It didn’t bear any relationship to the actual case.”

Giuliani, admired by some for his tough talk as Manhattan’s top prosecutor and his leadership as New York City’s mayor during the Sept. 11 terrorist attacks, struggled to answer even basic legal questions.

But he waxed on about a supposed conspiracy to rig the state election.

“The best description of this situation is widespread, nationwide voter fraud,” Giuliani argued. Under questioning, though, he acknowledged their complaint no longer included a fraud claim.

And then, just as it had at Four Seasons, reality came crashing down on him, when news broke in the courtroom that the Pennsylvania Supreme Court had rejected the campaign’s appeal over observer access in Philadelphia. It was one of the campaign’s last remaining claims.

Even the dissent was crushing.

“The notion that presumptively valid ballots cast by the Pennsylvania electorate would be disregarded based on isolated procedural irregularities that have been redressed ... is misguided,” Chief Justice Thomas G. Saylor wrote for the minority in the 5-2 decision.

Brann, who sits in Williamsport, let the federal court hearing drag on past the dinner hour, and gave both sides time to file additional motions. The campaign filings were replete with typos, spelling mistakes and even an errant reference to a “Second Amendment Complaint” instead of a second amended complaint.

The campaign took the opportunity to answer one of the more puzzling questions that its election challenge raised: [It only wanted the presidential election results set aside, not votes on the same ballots for other offices. The briefs were filed by Giuliani and co-counsel Marc Scaringi, a local conservative talk radio host who, before he was hired, had questioned the point of the Trump litigation, saying “it will not reverse this election.”

Aronchick balked at the campaign’s core premise that local election workers — perhaps working for the Mafia, as Giuliani suggested — had plotted to spoil Trump’s win.

“You’re going to suggest part of them are in a conspiracy? How does that work?” Aronchick asked. “Who? Where? When? How?”

Brann, in his ruling, said he expected the campaign to present formidable evidence of rampant corruption as it sought to nullify millions of votes. Instead, he said, the campaign presented “strained legal arguments without merit and speculative accusations.”

The 3rd Circuit, based in Philadelphia, may have already tipped its hand. In its Nov. 13 ruling, the appeals court called it “indisputable in our democratic process: that the lawfully cast vote of every citizen must count.”

Biden’s lead in the state has expanded to more than 80,000 votes.

“Our system depends on the possibility that you might lose a fair contest. If that possibility doesn’t exist, you don’t have a democracy,” said Levitt, the law school professor. “There are countries that run like that. It just doesn’t describe America.”

PHILADELPHIA (AP) — President Donald Trump’s legal team suffered yet another defeat in court Friday as a federal appeals court in Philadelphia roundly rejected the campaign’s latest effort to challenge the state’s election results.

Trump’s lawyers vowed to appeal to the Supreme Court despite the judges’ assessment that the “campaign’s claims have no merit.”

“Free, fair elections are the lifeblood of our democracy. Charges of unfairness are serious. But calling an election unfair does not make it so. Charges require specific allegations and then proof. We have neither here,” 3rd Circuit Judge Stephanos Bibas, a Trump appointee, wrote for the three-judge panel, all appointed by Republican presidents.

The case had been argued last week in a lower court by Trump lawyer Rudy Giuliani, who insisted during five hours of oral arguments that the 2020 presidential election had been marred by widespread fraud in Pennsylvania. However, Giuliani failed to offer any tangible proof of that in court.

U.S. District Judge Matthew Brann, another Republican, had said the campaign’s error-filled complaint, “like Frankenstein’s Monster, has been haphazardly stitched together” and denied Giuliani the right to amend it for a second time.


The 3rd U.S. Circuit Court of Appeals called any revisions “futile.” Chief Judge D. Brooks Smith and Judge Michael Chagares were on the panel with Bibas, a former University of Pennsylvania law professor. Trump’s sister, Judge Maryanne Trump Barry, sat on the court for 20 years, retiring in 2019.

“Voters, not lawyers, choose the president. Ballots, not briefs, decide elections,” Bibas said in the opinion, which also denied the campaign’s request to stop the state from certifying its results, a demand he called “breathtaking.”

In fact, Pennsylvania officials had announced Tuesday that they had certified their vote count for President-elect Joe Biden, who defeated Trump by more than 80,000 votes in the state. Nationally, Biden and running mate Kamala Harris garnered nearly 80 million votes, a record in U.S. presidential elections.

Trump has said he hopes the Supreme Court will intervene in the race as it did in 2000, when its decision to stop the recount in Florida gave the election to Republican George W. Bush. On Nov. 5, as the vote count continued, Trump posted a tweet saying the “U.S. Supreme Court should decide!”

Ever since, Trump and his surrogates have attacked the election as flawed and filed a flurry of lawsuits to try to block the results in six battleground states. But they’ve found little sympathy from judges, nearly all of whom dismissed their complaints about the security of mail-in ballots, which millions of people used to vote from home during the COVID-19 pandemic.

Trump perhaps hopes a Supreme Court he helped steer toward a conservative 6-3 majority would be more open to his pleas, especially since the high court upheld Pennsylvania’s decision to accept mail-in ballots through Nov. 6 by only a 4-4 vote last month. Since then, Trump nominee Amy Coney Barrett has joined the court.

“The activist judicial machinery in Pennsylvania continues to cover up the allegations of massive fraud,” Trump lawyer Jenna Ellis tweeted after Friday’s ruling. “On to SCOTUS!”

In the case at hand, the Trump campaign asked to disenfranchise the state’s 6.8 million voters or at least “cherry-pick” the 1.5 million who voted by mail in Philadelphia, Pittsburgh and other Democratic-leaning areas, the appeals court said.

“One might expect that when seeking such a startling outcome, a plaintiff would come formidably armed with compelling legal arguments and factual proof of rampant corruption,” Brann, a member of the conservative Federalist Society, wrote in his scathing ruling on Nov. 21. “That has not happened.”


A separate Republican challenge that reached the Pennsylvania Supreme Court this week seeks to stop the state from further certifying any races on the ballot. Democratic Gov. Tom Wolf’s administration is fighting that effort, saying it would prevent the state’s legislature and congressional delegation from being seated in the coming weeks.

On Thursday, Trump said the Nov. 3 election was still far from over. Yet he said for the first time he would leave the White House on Jan. 20 if the Electoral College formalizes Biden’s win.

“Certainly I will. But you know that,” Trump said at the White House, taking questions from reporters for the first time since Election Day.

On Twitter Friday, however, he continued to baselessly attack Detroit, Atlanta and other Democratic cities with large Black populations as the source of “massive voter fraud.” And he claimed, without evidence, that a Pennsylvania poll watcher had uncovered computer memory drives that “gave Biden 50,000 votes” apiece.

All 50 states must certify their results before the Electoral College meets on Dec. 14, and any challenge to the results must be resolved by Dec. 8. Biden won both the Electoral College and popular vote by wide margins.

And we have tremendous evidence. So we say, “We want to show you the evidence.” And then the judge will say, “They didn’t show us the evidence.” That’s what we want to do. We want to have hearings to show the evidence. The time people started seeing evidence was in Gettysburg, Pennsylvania, when people started showing it, you probably saw that. Great people came forward with affidavits, signed affidavits. We have hundreds of people like that. Hundreds and hundreds. They make it like we don’t have evidence. [Maria] Is there a path to victory?

[Trump] I hope so, for the good of the country. It will take a brave judge or a brave legislature. You know, Rudy Giuliani, he takes a lot of heat, let me tell you, that guy has guts, because we had lawyers that were afraid to go forward because they were threatened, viciously threatened. We have lawyers, Maria, good lawyers that had to leave the case in the middle because they were threatened. Absolutely threatened, both psychologically and otherwise. And they left the case. Numerous firms. Good firms doing a good job. And all of a sudden we end up having to scramble to get a case ready.

A lawyer spearheading the efforts by President Donald Trump’s campaign to dispute the election results in Pennsylvania complained to a federal court Sunday that she received an abusive telephone message from an attorney at the elite law firm representing the state, Kirkland & Ellis.

The Trump campaign lawyer, Linda Kerns of Philadelphia, said she received the one-minute-long voicemail Saturday morning from an associate — a very junior attorney — based in Kirkland’s Washington, D.C. office.

Kerns did not identify the Kirkland attorney by name or provide other details about the message, but said the communication “by any measure falls afoul of standards of professional conduct.”

Kerns’ filing said a Kirkland attorney working on the Pennsylvania suit told her that the lawyer who made the call was not involved in the case. Kerns said the attorney she contacted admitted the call was “discourteous” and apologized for wasting her time.

In a response filed with the court Monday morning, Daniel Donovan, Kirkland's lead attorney on the Pennsylvania-focused election suit, confirmed that he viewed the call as “discourteous and not appropriate,” but said he disagreed with Kerns’ characterization of it.

“That associate was acting unilaterally, in his personal capacity, without the knowledge or authorization of undersigned counsel or the Firm,” Donovan wrote.

“The associate provided a personal email and had a baby babbling in the background during the voicemail….The Firm expects that every lawyer will conduct themselves with the highest standards of professional conduct, including being respectful of and courteous to other members of the bar.”

Donovan said the unnamed associate was not aware of the firm’s role in the case and that no action by the judge was required.

Kerns’ complaint came as law firms working on Trump’s flurry of legal challenges in states across the country have faced public pressure from Trump’s political opponents to drop the litigation, which many legal experts view as fruitless and based on little or no evidence of actual fraud.

Some of the most prominent figures urging law firms to back out of Trump’s legal defense are associated with the Lincoln Project, a group of current and former Republican political consultants and activists who ran ads against Trump during the campaign and promised a similar media fusillade against the firms.

The torrent of criticism appeared to have an effect, as two firms working on the Trump cases — Arizona-based Snell and Wilmer and Ohio-based Porter, Wright, Morris & Arthur — withdrew, leaving the work to small firms and solo practitioners. The Trump campaign turned on its lawyers as they exited last week, saying in a statement that the attorneys had “buckled” to “leftist mobs.”

Trump opponents have also put pressure on a prominent law firm with extensive ties to the Trump administration, Jones Day. But that firm has said it isn’t involved in any suits initiated after the election, although it does represent the Pennsylvania Republican Party in litigation related to an extension of ballot-receipt deadlines in that state.


Kerns said in her filing submitted just before midnight Sunday that the call from the Kirkland associate was just one part of a stream of harassment and invective Trump attorneys have faced in recent weeks.

“Since this case was filed, undersigned counsel has been subjected to continuous harassment in the form of abusive e-mails, phone calls, physical and economic threats, and even accusations of treason — all for representing the President of the United States’ campaign in this litigation,” she wrote.

Kerns, who did not immediately respond to messages from POLITICO seeking more details, said some of the communications may have violated state or federal law.

However, she told U.S. District Court Judge Matthew Brann that the message from the Kirkland lawyer was troubling as a breach of professional norms.

Kerns said the voicemail message violated court and state bar rules, but added: “If there needs to be a rule saying that Kirkland & Ellis associates should not call opposing counsel and leave an abusive voicemail then all hope is lost.”

In fact, the Black community had very little enthusiasm for Joe Biden. You know that! You’ve been reporting on that! Very little enthusiasm for Joe Biden. And the Hispanic community has very little enthusiasm for Joe Biden. He didn’t get those numbers. And by the way, I was the most successful with the Hispanic and Black communities, I was unbelievably successful. You saw that: record numbers!

[Maria] Yeah. We’ve talked about that a lot.

[Trump] How did he get all of these votes? How did he get up to 80 million? How did he get up to 80 million votes? And again, I told you, we wanted to get 67, 68 [million] votes and we thought we had it made. John McLaughlin couldn’t believe it. John McLaughlin is a legitimate pollster, not one that says I’m 17 points down in Wisconsin, and then end up effectively winning. They tried to take it away, and we’ll see what happens with Wisconsin. But essentially, 17 points, a couple of days before the election, and I really won the state. It was 17 points off. Think of that. 17 points off. By the way, this is also corruption, Maria. This is also corruption.

[Maria] I want to ask you two more questions before we wrap up. I want to get your take on how much of an influence on this election was Big Tech and the media. We know that the media declared Joe Biden President-Elect on November 7th. They set the narrative that the election was over, and discredited any challenges. Big Tech and the media have been censoring you, and getting more aggressive at it. The President of the United States, and others, being censored, literally during a constitutional crisis. What can you do about it?

[Trump] It’s massively the powerful; it’s massively corrupt – the media and Big Tech. Section 230 should be taken out, because that’s their protection that was given artificially to them. But it’s a massive form of corruption and silence and suppression. Like for instance, this conversation that we’re having right now. They will only take if there was something that was slightly off, like you or I mispronounced a word, or you or I – that will be the story. And yet they won’t talk about Hunter Biden. Never talk about Hunter Biden. He stole millions and millions of dollars. And if you do talk about him, they take you off their platforms. No. It’s massively corrupt. I think what happened is in 2016 where I won, I caught them by surprise. I got them by surprise. And they said, “we’re not going to let this …” I don’t know why, though. Because business has never been better. You know, we got hit by a pandemic, but prior to the pandemic I had the highest numbers in history. And even now, the stock market just hit an all-time high during a pandemic. And what did I do? I came up with vaccines that people didn’t think we’d have for five years. And we have them. They are going to be distributed in two weeks. I mean, think of what we’ve done! And nobody’s done it like this. And we’re doing much better than Europe. By the way, you never hear about Europe. We’re doing better than the rest of the world. We’re doing better. But we have two vaccines. We’re coming up with another one. Johnson & Johnson is coming up with one. [Trump] And I’m the only one – they say it’s statistically impossible. I led the charge! We won state houses; we won Congress; we won the Senate; and I lost. They say it’s statistically impossible for that to happen.

An affidavit filed by President Trump’s legal team intended to prove voter fraud in Michigan apparently used data taken from counties in Minnesota, the latest in a series of embarrassing missteps that have made Mr. Trump’s uphill legal fight even steeper.

As part of the Trump campaign’s effort to discredit the results in battleground states, the lawyers Rudolph W. Giuliani and Sidney Powell have made a series of unsubstantiated and outlandish claims that Dominion Voting Systems, which sells voting software to states, electronically erased millions of Trump votes at the secret behest of liberal operatives.

To bolster that claim, they have pointed to areas that had abnormally high turnout rates compared to prior elections, most recently as part of a case filed in Georgia intended to show a nationwide pattern of fraud.

On Wednesday, L. Lin Wood, an Atlanta lawyer working with the team, filed an analysis from Russell Ramsland, a failed Republican congressional candidate and self-proclaimed election fraud expert, purporting to show suspiciously high turnout in blue areas of Michigan.

When the editors of Powerline, a conservative legal website whose contributors hail from Minnesota and other parts of the Upper Midwest, reviewed the nine-page document, they discovered a major problem: Many municipalities cited in the Michigan document — Monticello, Albertville, Lake Lillian, Houston, Brownsville, Runeberg, Wolf Lake, Height of Land, Detroit Lakes, Frazee, Kandiyohi — are located in an entirely different “M” state, Minnesota.

“This is a catastrophic error, the kind of thing that causes a legal position to crash and burn,” wrote John H. Hinderaker, a veteran litigator who believes any incidences of fraud are not on the scale Mr. Trump’s team is claiming.

Mr. Hinderaker surmised the error was the result of mixing up the abbreviations for the two states, “MI” for “MN.”


On Thursday, a federal judge in Georgia rejected Mr. Wood’s attempt to halt certification of Mr. Biden’s victory in the state. On Thursday, Mr. Giuliani said Mr. Trump’s team planned to plow on with its legal challenges in Georgia, even as it withdrew from cases in Michigan and Arizona.

Mr. Wood, Mr. Ramsland and Ms. Powell did not immediately respond to requests for comment.

An affidavit President Donald Trump’s legal team has hailed as proving fraud in the 2020 presidential election has a problem—the fraud it claims to show in Michigan used precinct listings that were actually in the state of Minnesota, in the latest legal gaffe involving the continually failing effort by Trump and his allies to show rampant voter fraud in the presidential election.

KEY FACTS

• The affidavit claimed to use data from the Michigan Secretary of State to show “a statistical anomaly so far outside of every statistical norm as to be virtually impossible.”
• Directly below that claim came statistics showing that the Benville Township precinct had a 350% turnout compared with the number of registered voters.
• But Benville Township is not in Michigan—it is in Minnesota, and only has an estimated population of 82 people, meaning that if even a handful of voters registered on Election Day itself, which is allowed in Minnesota, that could easily result in a much higher turnout than what was previously on the voter rolls.
• The affidavit goes on to list several other tiny townships in Minnesota, some even smaller than Benville.
• Trump’s legal team, particularly Sidney Powell, had promoted the affidavit as showing major evidence of voter fraud.
• Details of the document were first widely reported Friday by the pro-Trump Powerline Blog, which called the mix-up a “catastrophic error.”


KEY BACKGROUND

The affidavit was filed as part of a lawsuit that was neither in Minnesota nor Michigan, but in federal court in Georgia. That suit, brought by pro-Trump attorney Lin Wood, sought to discredit the state’s election results by claiming there were problems with the voting system. Like Michigan, Georgia uses the private company Dominion Voting Systems to tabulate election results—a system Trump and his supporters have continued to baselessly claim led to widespread fraud. The affidavit was filed Tuesday, and a judge threw out the case on Thursday, saying that the challenge came too late and “does not have merit.” Georgia also completed a hand recount and audit of its votes on Thursday, confirming President-elect Joe Biden won the state.

WHAT TO WATCH FOR

Efforts challenging election results have been plagued by what seem to be sloppy errors. Wood’s lawsuit, for example, mentioned voting problems in Mercer County, Georgia, which does not exist. Another suit challenging vote counts in Wayne County, Michigan, was filed in a court that had no jurisdiction over the matter. Meanwhile, Trump’s personal attorney Rudy Giuliani has continued to go off on rants in front of the press, making unsubstantiated claims of voter fraud, and seeming to forget basic legal concepts during a Pennsylvania hearing.

WASHINGTON – An affidavit from President Donald Trump’s legal team that claimed to prove widespread voter fraud confused two "M" states: Michigan and Minnesota.

The affidavit was as part of a larger lawsuit actually filed in Georgia by pro-Trump and conservative attorney L. Lin Wood that sought to discredit that state's election results by pointing to alleged discrepancies and problems with Dominion Voting Systems.


Trump, his legal team, and his supporters have continued to tout unsubstantiated claims that Dominion Voting Systems has led to widespread fraud in several states.

To point out the supposed problems with Dominion Voting Systems in Georgia, the affidavit, filed as analysis from Texas resident and cybersecurity expert Russell Ramsland, was intended to show supposed errors in Michigan, as both states use Dominion Voting Systems to tabulate election results.

However, the Ramsland affidavit appeared to confuse townships in Minnesota for Michigan.

Ramsland highlighted a number of "statistical anomalies and red flags" he claimed proved "that election results have been manipulated within the Dominion/Premier system in Michigan."

He specifically highlighted several precincts in Michigan where the number of votes cast appeared to exceed the number of registered voters in the county.

Many of the municipalities cited in the Michigan (MI) document, such as Albertville, Houston, Monticello, Runeberg, Lake Lillian, Brownsville, Wolf Lake, Height of Land, Detroit Lakes, Frazee, and Kandiyohi, are located in Minnesota (MN).


The affidavit was filed Tuesday. A federal judge dismissed Wood's lawsuit on Thursday, which sought to halt the certification of Georgia's election, saying it came too late and lacked merit.

Georgia completed a hand recount and audit of votes on Thursday, confirming President-elect Joe Biden won the state.

The "risk-limiting audit" found Biden won Georgia by 12,284 votes, a narrower margin than the 14,196-vote lead he held immediately following the election. Local election administrators identified uncounted ballots in four counties. Each was the result of human error.

On Friday, saying "numbers don't lie," Georgia Secretary of State Brad Raffensperger certified those election results.

Trump’s legal team had promoted the affidavit as proof of widespread evidence of voter fraud.

Ramsland had claimed in the affidavit that "excess ballots" were allegedly processed, but it is unclear where the data listed came from.

According to actual data from the Minnesota Secretary of State, there were 4,202 registered voters in Monticello P-2, but only 3,776 votes were cast in the presidential election.

USA TODAY has reached out to Wood for comment.

This Georgia lawsuit that mixed-up Michigan and Minnesota is just one of several filed by Trump's legal team that have been dismissed.

And they criticized it, not only because there wasn't any data behind a puffing 95% assertion, but they didn't distinguish between moderate cases, serious cases, and how much actually it prevented hospitalization and fatalities. So, take that 95% with a grain of salt as just advertising puffing by two drug companies.

It's unfortunate that most of the media, Steve and David, just swallowed it whole and kept repeating it and repeating it, repeating it uncritically even though Public Citizen sent their statement out [to] everybody in the media and it didn't make much difference except it was pointed out in the Wall Street Journal and a couple other publications.

attack on the capitol. So she texted to
Melania, "Do you want to tweet that
peaceful protests are the right of every
American, but there is no place for
lawlessness and violence?" And Melania
wrote back,

things Melania has said yes to over the

She said yes to visiting an immigrant
and child detention center wearing a

in first lady history "be best."
She said yes to questioning the
legitimacy of Obama's birth certificate.
And worst of all, she said yes to a
proposal from Donald Trump.
Which is basically opting to go to a
gold-plated prison, and become a
stepmother to the four vampire children
Donald Trump calls his children.
Speaking of women I despise, let's talk
about Virginia Thomas, wife of Clarence
Thomas.
She's the worst.
And I don't want you to think that I
enjoy bashing women. I only despise women
who fall into one of three categories:
(1) they hate other women, (2) they're married to
a man who hates women, (3)
or they're a racist whose cover is being
married to a black person.
Virginia Thomas is all three.
She's refusing to testify before the
house select committee about her role on
January 6th. She sees no reason to
testify, when all she did was help lay
the groundwork for the riot, talk to
everyone involved in planning the riot,
and then attend the rally that led to
the riot.
It's like, can she really just not go
testify? How fucked up is it that? Virginia
Thomas is the only woman in America who
still has the right to choose?
Also,
Ginny or Virginia or whatever your name is,

Ragina's lawyer sent a letter to the
committee that ended with this little
gem, "I am left to believe if her name
were Jenny Jones, the committee would

in the republican primary for governor
last night. "We're asking every New Yorker
